— Ace Rand Paul announced he was filing a class action lawsuit against the "generalized warrant" regime of the current NSA.
“The question here is whether or not, constitutionally, you can have a single warrant apply to millions of people,” Paul said. “So we thought, what better way to illustrate the point than having hundreds of thousands of Americans sign up for a class action suit.”Paul said he began collecting signatures about six months ago, and says it’s “kind of an unusual class-action suit” because everyone in America who has a cell phone is eligible to join in the legal action, he said.
He added that Ken Cuccinelli, the current attorney general of Virginia who ran for governor last year, is part of the initiativeÂ’s legal team.

Ultimately, the freshman senator says he wants President Obama to follow the constitution.
Paul said we "fought a Revolution" against government abuses such as the generalized warrant.
Peter King, generally a RINO, is "conservative" on one issue, and that issue is non-IRA terrorism, always arguing for the most maximalist response to terrorist threats. He says Rand Paul is spreading "lies" and "fear" about the NSA.
Appearing on Fox News Channel on Sunday, Rep. Peter King (R-NY) defended the National Security Agency from attacks on its intelligence gathering practices. He specifically said the charges made against the NSA by Sen. Rand Paul (R-KY) are “lies” and that he “doesn’t deserve to be a U.S. Senator.”“Rand Paul does not know what he’s talking about,” King said after being asked to respond to Paul’s comments about the NSA. “And, Rand Paul is really spreading fear among the American people.”
“He was also was comparing General [James] Clapper to [Edward] Snowden,” King continued. “To me, he’s either totally uninformed or he’s part of that hate America crowd that I thought left us in the 1960s.”“In any event, he doesn’t deserve to be in the United States senate for spreading that type of misperception and absolute lies to be honest with you,” the congressman concluded.

King insists that no "content" of cell phone calls is being listened to, except when a known terrorist calls a US citizen. I don't know if that's true. But it is not true that the NSA is not gathering content on US citizens' cell phone activity via this "generalized warrant." All your so-called "metadata" (location, call history, etc.) is being gathered in a dragnet and stored, potentially forever.

But we're in an era of Permanent War.
In actual wars we kicked Saddam's and the Taliban's asses in about six weeks each, then engaged the suck and became part of their problems. And the War on Terror can never go away because homeland security is a bottomless hunger for money and power and intrusion into your lives.

In the "Arab" section, one of the nicknames listed was "desert Irish".
King is a fairly good example of the very low level of quality the country has in its representation, especially in the GOP (the Dems are so bad they've fallen off the low end of the chart, incl. those I know personally). Which, sadly, pretty much reflects the quality of those represented. I fear. I never spare the few non-retarded folks I ever talk to about matters political or national, always remind the it's their neighbors, family members, co-workers, and social circle that is responsible for the state of things, not "them" or some abstract political class. A few have finally acknowledged this - and understandably it has depressed and deflated some of them to an appropriate extent.

I still have this image of ace freezing his ass off. He's probably blogging from some garret furnished with only a cot, a small wooden table/chair, and a wood burning stove. He's wearing a wool hat, a raggedly blanket around his shoulders, and pervy gloves. He had a cat but was forced to burn it to keep warm...that was sad. Ace's only company now is some hooker named Mimi. Mimi has consumption and coughs loogies out all over the place. It's very disgusting. But, ace puts up with it all to keep you assholes entertained...

Bullshit. I would bet a million dollars (if I had it) that they do fishing expeditions on that data all the time.
Let's say I have a theory.. my theory, as an NSA analyst, is that calls made from the US to, let's say, Yemen at a certain time of night might be terror related. So, I do a database search with very specific criteria. Give me all the calls that are repetitious in nature from 12am to 2am from the US to Yemen.
I will get a list of phone numbers and I bet at this point NSA will research those numbers without a warrant.
I am betting they have a lot of detailed info before they go ask for a warrant.

It wasn't unconstitutional then because it was "international" communications that were collected, to which no persons, even US persons, had a right to privacy up until such time that it was verified that it was in fact a US person in the communications, and so long as that US person was not engaged in illegal activity.

I think Pete King's a blowhard who's crossed the line in a major way here. I like Rand Paul a bit. But I'm tired of the "GOP heroes and villains" narrative. Over on Hot Air, the most recent Scott Walker post has been taken over by the frothing lunatics who increasingly seem to run that place proclaiming that Walker is just a RINO sellout whoring for the establishment and pushing open borders. (I could go the rest of my life without reading the braindead term "GOP-e," which is a clear signifier that the writer has ceased attempting to think critically and is just running on sub-primate Id at that point.)
The worst part about it is the nakedly cynical way Allahpundit eggs it all on. I get that he has a job and it doesn't pay to antagonize your clientele, but still...the way he panders these days, all the while making it clear (in a way most of the people there are just too fucking stupid to even grasp) that he has contempt for most of the commenters...well, it leaves a bitter taste in my mouth.

Because it is a complicated issue where reasonable people can disagree. John Bolton defends the NSA collection also. Mike Rodgers and others should have to defend legitimate concerns and if we can't get the head of the NSA to tell the truth when testifying before Congress, then I do not fault Rand Paul from taking this strategy and I am not necessarily a Rand Paul fan. I'm a Bolton fan who disagrees with him in part. Checks and balances is essential and one side is saying trust us. Yeah not so much.

Just as a little backstory....there are about 35000 folks who work at NSA, give or take, and many of those are actually active duty servicemen/women. Besides the normal USSID 18 (US Signals Intelligence Directive) laws which protect communications of US persons, the military folks are bound by the Posse Comitatus Act. Now, that's not to say that things aren't being abused, but there are laws in place to protect communications of US persons.

Polynikes. I doubt very much NSA is looking at any communications from US persons except for ones that go into/out of suspect countries and areas. The sheer volume of available data and need to analyze prevents the time or resources to worry about Joe calling Acme gun sales to find out if his custom 1911 is ready. If it's Achmed from south Sudan calling Acme gun sales to inquire about a shipment of 1911's....that's different.

I'll admit I'm a bit bias in favor of the giving NSA the benefit of doubt as to their activities...but just like any organization, especially one so large, I don't discount outlier activity.
