Rep. Peter King: Rand Paul Doesn't Deserve to be a US Senator

Rand Paul announced he was filing a class action lawsuit against the "generalized warrant" regime of the current NSA.

“The question here is whether or not, constitutionally, you can have a single warrant apply to millions of people,” Paul said. “So we thought, what better way to illustrate the point than having hundreds of thousands of Americans sign up for a class action suit.”

Paul said he began collecting signatures about six months ago, and says it’s “kind of an unusual class-action suit” because everyone in America who has a cell phone is eligible to join in the legal action, he said.

He added that Ken Cuccinelli, the current attorney general of Virginia who ran for governor last year, is part of the initiativeÂ’s legal team.

Ultimately, the freshman senator says he wants President Obama to follow the constitution.

Paul said we "fought a Revolution" against government abuses such as the generalized warrant.

Peter King, generally a RINO, is "conservative" on one issue, and that issue is non-IRA terrorism, always arguing for the most maximalist response to terrorist threats. He says Rand Paul is spreading "lies" and "fear" about the NSA.

Appearing on Fox News Channel on Sunday, Rep. Peter King (R-NY) defended the National Security Agency from attacks on its intelligence gathering practices. He specifically said the charges made against the NSA by Sen. Rand Paul (R-KY) are “lies” and that he “doesn’t deserve to be a U.S. Senator.”

“Rand Paul does not know what he’s talking about,” King said after being asked to respond to Paul’s comments about the NSA. “And, Rand Paul is really spreading fear among the American people.”


“He was also was comparing General [James] Clapper to [Edward] Snowden,” King continued. “To me, he’s either totally uninformed or he’s part of that hate America crowd that I thought left us in the 1960s.”

“In any event, he doesn’t deserve to be in the United States senate for spreading that type of misperception and absolute lies to be honest with you,” the congressman concluded.

King insists that no "content" of cell phone calls is being listened to, except when a known terrorist calls a US citizen. I don't know if that's true. But it is not true that the NSA is not gathering content on US citizens' cell phone activity via this "generalized warrant." All your so-called "metadata" (location, call history, etc.) is being gathered in a dragnet and stored, potentially forever.

In the "Arab" section, one of the nicknames listed was "desert Irish". 

 

King is a fairly good example of the very low level of quality the country has in its representation, especially in the GOP (the Dems are so bad they've fallen off the low end of the chart, incl. those I know personally).  Which, sadly, pretty much reflects the quality of those represented.  I fear.  I never spare the few non-retarded folks I ever talk to about matters political or national, always remind the it's their neighbors, family members, co-workers, and social circle that is responsible for the state of things, not "them" or some abstract political class.   A few have finally acknowledged this - and understandably it has depressed and deflated some of them to an appropriate extent.

They've got a general use case warrant that allows gathering all metadata and etc. The methods only work for pattern finding with Total Information Awareness. They've also tried to argue that because they're gathering info on everyone, nobody is singled out.

That's why they need a complex 7X the size of the pentagon out in the desert. But they are not recording content because they say so. And if they are they are not listening without a warrant. Let's say I have a theory.. my theory, as an NSA analyst, is that calls made from the US to, let's say, Yemen at a certain time of night might be terror related.  So, I do a database search with very specific criteria.  Give me all the calls that are repetitious in nature from 12am to 2am from the US to Yemen. 

I will get a list of phone numbers and I bet at this point NSA will research those numbers without a warrant.

I am betting they have a lot of detailed info before they go ask for a warrant.

217 I'm of two minds about this.  I'm very protective of my personal information...but at the same time, when I worked at NSA back in the 90's these "vacuum everything up" type of collection was already being done, albeit not with cell phone data, but with normal telephone calls, banking information, etc.  But there were protections and protocols in place to protect the information and only those with legit mission need to know were allowed access and all database queries were logged and you'd get absolutely hammered if you abused the access.  So the "metadata" and then some was already collected, but just gathered dust until someone had a need to query for that specific information.  It helped me track years old weapons shipments to a specific MENA (I just dated myself) country.

Because  it is a complicated issue where reasonable people can disagree.  John Bolton  defends  the NSA collection  also.   Mike Rodgers and others should have to defend legitimate concerns and if we can't  get the head of the NSA to tell the truth when testifying before Congress,   then I do not fault Rand Paul from  taking this strategy  and I am not necessarily a Rand Paul fan.   I'm a Bolton fan who disagrees with him in part.   Checks and balances is essential and one side  is saying trust us.    Yeah not so much.

Just as a little backstory....there are about 35000 folks who work at NSA, give or take, and many of those are actually active duty servicemen/women.  Besides the normal USSID 18 (US Signals Intelligence Directive) laws which protect communications of US persons, the military folks are bound by the Posse Comitatus Act.  Now, that's not to say that things aren't being abused, but there are laws in place to protect communications of US persons.

Polynikes.  I doubt very much NSA is looking at any communications from US persons except for ones that go into/out of suspect countries and areas.  The sheer volume of available data and need to analyze prevents the time or resources to worry about Joe calling Acme gun sales to find out if his custom 1911 is ready.  If it's Achmed from south Sudan calling Acme gun sales to inquire about a shipment of 1911's....that's different.

254 JEM...I agree that there is a chance of an NSA "Star Chamber" analysis effort being conducted by those who wish to target specific people they feel are a threat.  I can't discount rogues from existing, I can only opine that if it is, it's not very large.  You have to remember, unlike the IRS, NSA and any other members of the US intelligence community, don't have an enforcement arm like Treasury does.  They could only pass the information on to another agency like DHS or FBI.

264 Fish, I cannot argue against your experience and I respect your insight, I really do, but according to numerous leaks about operations since 2005 the NSA records purely domestic content and stores it and (since EO in 2009) shares intel with federal LE. It has been revealed in open court that the NSA passes on data to start LE cases domestically and has for some time. Now, if even the EPA and student loan branches of the government have paramilitary LE departments this century and the NSA is required to share intel it stands to reason there has to be a process and massive pressure for these LE branches to line up at that door for intel to start more cases. Just seems like common sense notwithstanding the actual Snowden documents and statements by the Community in passing. A few good men cannot stand up against the promise of absolute political power for long.

The President has broad authority over what we do overseas, but domestic surveillance isn't his private reserve, and never has been.
