Here it is


CNN asks if it was legal to record and release Sterling's rant.  They discuss State law but fail to mention it was also a violation of federal law, namely the electronic communications privacy act (18 U.S. Code § 2511).   There are no provisions under the act for federal punishment, however he can seek damages from his ex-wife.  If he has to fight the NBA in court she will be liable for all the costs, including the cost of the team if he loses it.  



I hope she is aware of the shit storm she has made herself liable for. And CNN should do a little research before they publish shit.   And speaking of CNN and other news services who are publishing her crap, perhaps they should talk to their lawyers as well. They are not exempt from this law.

But what I have found in my lifetime is that companies who do this kind of shit to their employees don't last long.  The other employees start bailing at first job opportunity and nobody will hire on.   Word does get around.

The First Amendment is not the beginning and end of freedom of speech in the US.

It's also a larger cultural value that allowed people a certain space to express views and participate in our political process without the entirety of their life being at risk over it. And that space is quickly being eroded as the number of speechcrimes and thoughtcrimes that result in you losing your job and being purged from decent society grows. This is a very bad thing.

And yes the company's actions are completely legal. Which tells you nothing about whether they're moral, just, or part of the American ethos. The slave factories in China are also completely legal.

CNN asks if it was legal to record and release Sterling's rant. They discuss State law but fail to mention it was also a violation of federal law, namely the electronic communications privacy act (18 U.S. Code § 2511). There are no provisions under the act for federal punishment, however he can seek damages from his ex-wife. If he has to fight the NBA in court she will be liable for all the costs, including the cost of the team if he loses it.


I hope she is aware of the shit storm she has made herself liable for. And CNN should do a little research before they publish shit. And speaking of CNN and other news services who are publishing her crap, perhaps they should talk to their lawyers as well. They are not exempt from this law.

No, you are reading that wrong. Under federal law, it is illegal to intercept someone else's call. If George is on a call with Bob, and I somehow am able to secretly intercept that call, that is illegal. But, if Bob tapes all his calls, that is not an interception or an illegal wiretap, or in any other way illegal. The federal standard in commonly referred to as "one party consent". That is, if at least one person in the conversation is aware that it is being recorded, it's legal.

California and a few other states use what is commonly called "two party consent". But, that is kind of a poor descriptor. It should be called "all party consent" or something, because what the law in those states is, is that everyone on the call has to be aware that it is recorded. Normally, that will just be two people, but if it is a conference call or something like that, every single person has to be notified.

380 My grandfather was Army Air Corps in WWII.  Waist gunner on a B-25, as well as a mechanic and ferry pilot (from base to base).

Usually, when ferrying aircraft, they were stripped. No defensive armament.

He was shot down over the Philippines. Woke up in South Carolina 6 months later.  Was the only one to live.

That man knew more off-color jokes than I can even remember. Yet one of his favorite acquaintances was the only black man who lived in our very very small town.  Had nothing but good things to say about the man.

So, this guy, this fundamentally decent guy who said a fair share of un-PC things in private, when among family and friends, should be posthumously stripped of any honor.  You know, to meet the same standards that the left would impose on all of us.

True.  But there's a reason he was able to retain O'Mara, et.al.

Certainly not his own resources.  People saw he was being railroaded, and stepped up.

Unfortunately this happens all too often when no one is aware of it.  But at least when the racial grievance-mongers attempt to burn someone at the stake, and enough people find out about it, they can still stand in the way.

Today, with the advent of the internet, Twitter, and Facebook, they now have the same platform as if they were standing on the courthouse steps or were taking out a full page ad in a newspaper. 492 #494--Good points, some of us forget that the Net & social media now enable the views--which can be easily distorted or cartoonized-- of an identified employee (or executive) to be permanently affixed to a company, so companies may appear to be going nuclear when they see no real alternative, other than accepting a boiling stew of customer base.  This is a very underappreciated & troubling aspect of the Net age.  As I tried to say wayyyy earlier tonight, this guy at TurtleRock cd be cartoonized--unfairly but "accurately" as having "called racist philanderer Donald Sterling a 'victim.'"

The guy's tweets were OBVIOUSLY not in that spirit, but in a competitive industry, who needs to take time to explain to a [probably Astro-turfed] customer cohort the finer points of his argument?

Back in the pre-Net day, no-one's views wd ever be in the public domain unless they were a public figure.  EXCEPT...Once in a great while, one of us plebes wd experience the awesome experience of...GETTING A LETTER PUBLISHED IN THE NEWSPAPER!!  A moment in the arena!!  BUT...Your employer was never identified.  There was no Net for activists to triangulate you & mobilize against your employer.  The letter was usually edited down to some bland pabulum, in any case...In 24 hours, your glittering comments went down the memory hole, where your boss & co-workers cdn't care less!

When I started on the Net 20+ years ago, I didn't use my real name.  One day, in a moderated forum, a Muslim guy said he'd "put a bullet in my head"--the liberal moderator did nothing. This taught me that, unless you are a professional opinion-monger, that controversial views aired in public may be dangerous if even 1 sick person out there--Kimberlin, maybe?-- can determine where you live, or work.  But that was before the era of these cyber lynch-mobs, which add a whole new dimension.

I guess the lesson here is, if you wish to make a strong stand against a mob opinion today, you need to at least detach from your employer.  If you're self-employed, factor in a boycott possibility.  Don't be blind-sided.  And, I wd respectfully repeat, don't refer to a self-defined cartoonish billionaire philandering jackass like Donald Sterling as a "victim." You're just asking for trouble.

Oh, and a couple of points for the legally-inclined folks out there on Sterling:
1--He who seeks equity must come with clean hands.
2--Yes, he was probably taped unlawfully, but he shd be smart enough to remember the rule of "the unreliable ear."  So maybe his ho gets a tap on the wrist, but he loses his franchise? Idiot. And the conversation is with his mistress, while he is still married.  No equity for him, sorry.
