Senator Ron Johnson To Sue Government Into Lawless Enforcement of Obamacare
— Ace

He's specificlly suing over one of the many lawless "interpretations' of the law -- the special, illegal treatment that Congressmen and their staffs are receiving.

But who knows. Maybe we can get this rolling into a general suit about the illegal Enabling Act we call Obamacare.

Only members of Congress and their staff, when they lose their employee sponsored care, will have the ability to have their employers make a tax advantage contribution to their healthcare plan. That's the special treatment. That's completely unfair and completely unjust."

"The law as it has been written is being ignored," explained Johnson.

"This is the law of the land. If members of Congress and the administration don't like the law of the land, they should come to Congress to change the law of the land. They should not change it by presidential decree or presidential fiat."

In addition to basic fairness, Sen. Johnson said the lawsuit has the intention of "providing a long overdue check on presidential power."

But we live in a system where it takes 50 lawyers a week to tell you if the insurance you have is legal. And then Obama changes his mind, and that determination is null and void. That's the textbook definition of tyranny.

Except it's not just Obamacare. It's also the enormous number of other areas in which Obama completely ignores duly enacted law, essentially nullifying it, in open defiance of the specifically enumerated Constitutional duty of presidents to see that said laws be "faithfully executed".

By now, it ought to be clear to anyone who is paying attention that Obama will continue to reign as an arrogant imperial figure at his own whim, law and Constitution be damned, until he is actively reined in by Congress and/or the courts. Neither of whom appear to have the spines to do so.

Absolutely.   But we need to start somewhere, and this Obammycare fiasco is a very large, very public, very visible example upon which to crucify our Pretender Preezy in Chief.   It would set a precedent.

The President is issuing edicts and Congress is issuing laws so quickly, SCOTUS can't possibly rule on even a percent of it. And Congressmen have an attitude that it's not their job to determine Constitutionality of a law, only to get votes. So what's the check on any of this? I think SCOTUS needs to have a check on itself, and the system I propose is one possibility.

Because that's what the Congress is supposed to do? And it's much, MUCH easier to stack the lower courts than it is to stack SCOTUS. One of the things I have learned the hard way is to refrain from opinion when I know I don't know the facts.  That being said, the idea that a cop would shoot someone to save time or get home early enough to catch the Gilligan's Island marathon is just pure crap.  When a cop fires a gun in the field, that is when things start, not when they end.

225 Before my brother became a "real" cop, he was a UMass Hospital cop, often assigned to the "Sixth Floor", where every variety of mentally disturbed patients/prisoners were sent. After a while he and a partner came up with a routine where they would just recite funny movie lines, make fun of each other, etc. until the person freaking out laughed or joined in or got annoyed that everyone but him was laughing. I don't know how often it worked, but watching them act it out was hilarious.

An aside on standing.  I was stopped by MA police who were just sitting by the road typing license plate numbers into a computer.  They got a hit on me.  It was a mishit (two computers didn't agree whether I was driving under a suspended license, so they went with the one that said I was wrong.  I wasn't.)

 

Anyway, it seemed to me that randomly running numbers when I'm not missing a taillight or running a stop sign or anything was an illegal search under the 4th, and I wanted to challenge it.  I thought I could get the ball rolling myself and then get some Cato types to help.  They said "pay $300 and will dismiss the charges".  I said "fuq you, I want a trial".  They said "pay $100 etc.", I persisted.  They might even have started at $600, I went to court a lot of times.  Eventually they said "Nol Pros" or words to that effect. 

 

I said to the judge, "I've been coming back to the court to challenge this law, and if there is no case I don't have standing".  And the judge said "there is no case". 

 

Since then the jurisdictions I drive through in CT don't even have to type in plate numbers.  They have scanners that read plates and ping databases.

239 "The law as it has been written is being ignored" is not the sort of argument you want to make before a Supreme Court Justice who ignored the law as it was written.

The traitor Roberts gave everyone free rein to make the law into whatever they like when he did exactly that himself.  He made it official that any word is as good as another when it comes to our laws.  Can may be cannot, will may be will not, mandate may be tax and one date is as good as another.
