Supreme Court Rules It's Ok For States To Not Discriminate Based On Race In College Admissions

It's amazing that self-anointed "leaders" of the civil rights movement in this country had actually twisted themselves to the point where they were arguing there was a constitutional mandate to discriminate based on race in college admissions. But we were.

The Supreme Court didn't rule that race based admission factors were unconstitutional. The 6-2 majority simply says that states once having created such preferences could legally remove them.

The justices said in a 6-2 ruling Tuesday that Michigan voters had the right to change their state constitution to prohibit public colleges and universities from taking account of race in admissions decisions. The justices said that a lower federal court was wrong to set aside the change as discriminatory.

Justice Anthony Kennedy said voters chose to eliminate racial preferences because they deemed them unwise.

Kennedy said nothing in the Constitution or the courtÂ’s prior cases gives judges the authority to undermine the election results.

I for one am gladdened and amused by Kennedy's new found respect for the people's right to amend their state constitution. I'm sure he'll lose it the next time his magic coin comes up the other way.

I'm having trouble downloading the opinion but I'm guessing Kagan recused herself from the case because of her work a Solicitor General. Ruth Bader Ginsberg joined Wise Latina Sonya Sotomayor's dissent which she read it from the bench (something justices do to show they have a sad over a decision).

I guess that means Steven Breyer joined with the majority which is...weird.

University of Michigan President Mary Sue Coleman and admissions director Ted Spencer have decried the affirmative action ban, saying outright that the school cannot achieve a fully diverse student body with it in place.

"It's impossible," Spencer said in a recent interview, "to achieve diversity on a regular basis if race cannot be used as one of many factors."

Fifty-eight percent of Michigan voters in 2006 passed Proposal 2, a ballot initiative that amended the state constitution and made it illegal for state entities to consider race in admissions and hiring. With the Supreme Court's ruling, the only way left to nullify Proposal 2 is to mount a long, expensive and uncertain campaign to overturn it.

You want to fix the racial diversity issues in colleges? Ok, start with elementary and high schools. Start turning out students from places like Detroit that are ready to compete for slots at schools like U of M. If that means blowing up the public education system and the teacher's unions and replacing them with voucher programs and charter schools, so be it. It's "for the children" after all.

(He happens to be the only black kid in his grade, I think.) But no, black people are naturally inferior, so let's not make any efforts to actually improve their education. 69 Of the state universities in Michigan, The University of Michigan is the most difficult to get into. What often doesn't come up in discussions about using racial preferences, is that the students who get in, but don't have the academic background of other students, are being set up for frustration, and even failure. They would probably be happier and more successful at one of the other universities.

NBA is 85% black when blacks are 14% of the population. NBA has 1 asian dude. In terms of "looking like America", the NBA is far less diverse than the NFL or the MLB. MLB actually closely mirrors the ethnicity of America, percentage wise. Yet NBA is though of as the Most Diverse. Cause it has the highest % of black players and the lowest % of white players of the major sports. In real life, the Left sees 5 white people and see 0% Diversity. They see 5 black people and they see 100% Diversity. They see 5 asians and they just get kinda confused and drift off.

I was in all honors classes in HS (I was told that was a big deal, personally, I'm unconvinced). There was one Portuguese (don't call her "hispanic," "Spanish," or "Mexican" if you value your life) girl and one Black boy who were in most of my classes (I *think* also all Honors, and just some schedule differences). They kicked the crap out most of the white kids, academically. 'Cause they put in effort.

Your comment about "acting white" made me think of a Key and Peele skit that I saw recently.  I believe it was the first episode where Key is talking on a cell on a street corner and then Peele comes into view, also talking on a cell phone.  At first, Key is talking like a normal person but when Peele comes into earshot, he suddenly changes his speech to sound like he's a thug gangster because Peele's character is also talking like one.  Key doesn't want to sound like "white" so he changes his tone and demeanor.  When Peele walks away, he changes back to his normal voice.  Peele's character is seen walking away, talking on his phone, telling the person that he "narrowly escaped almost getting mugged" in a normal sounding voice.


Haha!  Funny right?


Then Key and Peele are back in front of the audience explaining to everyone that both of them are biracial and learned to adjust their speech and tone whenever other black people were near them, lest they were thought of as "acting white".  And then it struck me, how incredibly racist this sounded.  Some black people believe they have to act and sound different around other black people or else be thought of as "not black".  As if that makes any logical sense!

I don't know that I would call that a flip-flop.  The presence of a specific ban in a State constitution is a very relevant new factor.  Not that I agree that U of M was right even before the State banned the practice, but I do think it's legitimate to change the decision once the State did.  


Also, I don't know which Justices changed their vote from the 2003 decision.  I imagine Thomas and Scalia were pretty consistent one way and Ginsburg consistent the other, and Roberts, Alito, and Sotomayor (and the recused Kagan) weren't even on the court at the time.  So that means Kennedy likely changed his mind, as he does, and maybe Breyer too.

153 It all brings to mind the case of the missing girl in DC, Relisha Rudd. Her "Mother" let a janitor take her and no one noticed she was missing until several weeks after the fact. The local news here in DC is on the air with specials on "Where we failed Relisha" and the like. Her "Mother" has been interviewed several times and without a hint of irony lashes out at the system that has failed her daughter. It really is unbelievable to me. Most of these kids are doomed at birth with faulty parents. School systems don't stand a chance in setting 90% of these kids down a correct path. It is all acceptable because most of these kids are black. It makes my blood boil.

That being the obtainment of marketable skills that have some use in the outside world. How does a more racially mixed class help with teaching engineering or statistics? I'm not sure it does. Is there some great insight about linear regression I'm missing because my class doesn't have enough wise Latinas in it? It seems like the only place where diversity experience really helps are in the liberal arts degrees, but those have become costly and not terribly useful as of late. Besides when every preferential enrollee joins up with their tribe and then isolates themselves from the rest f the campus, I don't think that we've accomplished anything.

214 California has a similar problem, in that there is a controversial proposal wending its way  towards  enactment  to end racial preferences in  public  university  admissions.  Ending racial preferences would result in a substantial increase in kids with Asian ancestry at Berkeley and the other UC schools, and a reduction in caucasian/black/native american and others.  "Diversity" would be a thing of the past.

Doing hard things to show off what you are capable of is nice, don't get me wrong.  Everyone should endeavor to become successful enough to approach a difficult yet rewarding project, however it is an ego project on some level.

Consequently, there are constant planeloads of people from Asia on the SF area public courses. Rarely does one hear English on the 7th tee.

I once did a (blissfully) short tour as cadre at one of the Army's officer training schoolhouses.  One of my duties was to grade the English proficiency writing sample of brand new Second Lieutenants.  This was done in the blind, no name, no biographical data, only a Test ID number.  Then the number was mated to the student's data after the sample was graded.

I got pretty good at spotting "graduates" of Historically Black Colleges and Universities, because the errors were so stunningly similar.  I did this for 18 months.  Eighty writing samples every two months....for 18 months.

Golf fees are so expensive in Japan and Korea now that it is actually CHEAPER for the average player to get on a plane and fly to San Francisco and play a round of golf at a beautiful public course with a $28 fee for 18 holes than it is to play a round at a course back home in Japan, which often costs $500 at a minimum, plus huge annual dues because most courses are private. Consequently, there are constant planeloads of people from Asia on the SF area public courses. Rarely does one hear English on the 7th tee. Had a woman in my office a few years back (she's black) whose daughter got into MIT.  She was all excited and proud and just goin' on and on and on.

Came out a little later in the conversion that she got in on an affirmative action admit, because she didn't have the grades or the SAT scores to get in on her own.  Then MIT put her through a boot camp the whole summer prior to frosh year to make sure she was ready for college.  There were no white kids in the boot camp IYKWIMAITTYD.

Her major was chemical engineering.  She's not working as a chemical engineer today.

Nobody is doing these kids any favors by making think they are better than they are.

Knew a guy whose great grandmother died with a ton of shares of RJR Reynolds that were split up amongst the family per her will.  His family's share at that time was worth about $1.5 million.  The smart play was to hang onto them and let them rise in value.

Nope.

Liquidated everything and bought a McMansion with new cars for him and his brother.  Both promptly wreck their new cars.  Parents replace them with two more new cars.  Both wrecked again.  By this time, the dad had spent a shit-ton on guns and a security system to protect them.  Soon, their debts caught up with them and they were forced to sell off most of what they acquired.

Stupid people with sudden access to large sums of money will end up poor again.

It'll take another twenty years or so to catch up with what they'll be doing after this decision. -------- The original vote by the people was a hard won fight. There is a program by which UT Austin guarantees admission to students who are good enough, but not in the top 8% (it's now 8 for Austin) in their high schools to go to one of the other colleges in the UT system for freshman year, take certain specified courses, make a GPA above a cutoff score, and automatically be eligible to transfer to Austin for sophomore year. A&M does the same thing.

O/T  Ukraine report on the local 11am news. 

 

Someone finally noticed that Russian Spetnaz troops are in the Eastern Ukraine and leading the "pro-Russian Ukrainian" separatists.  Because Vlad wants to control the pro-Russian demonstrations and riots. 

 

The geniuses at ABC News are disputing the report.  ABC News interviewed several of these separatists, and said that they are probably Ukrainian, because they have Ukrainian accents!  These are the best and brightest reporters we have, and they bring the facts to us. 

 

Local Accents.  OMG, that proves it!!!  They must be ukes.  Because Russian Spetnaz troops assigned to Ukraine would never be trained to speak like a local, with a local accent!   --- Actually, if they do not learn to speak the local language flawlessly, they are beaten until they do.  And until they do, they are not sent across the fcuking border!   

 

Just like the Spetnaz that will be sent to the US will speak American English flawlwssly.

Hard work MIGHT pay off in the end, but it doesn't have to. Hard can CAN, and often DOES, leave you with nothing but empty pockets.

 

However, when something seems too easy ... or too good to be true ... it is. But I'll be damned if I look at a task ahead and think "This will be so much more rewarding if I do it the hard way". That, my friends, is bat-shit fucking crazy.

264 It won't.  There are limits to what can be done.Most bright kids in good situations can approach their upper limits, but ghetto kids in shit-show schools are nowhere near those limits. It's easy to teach any kid the basics, which is what is needed in the ghettos

I don't agree (with your assertion that blowing up public schools in the ghetto and elsewhere would benefit ghetto kids more and help close the gap).   

 

And neither does Charles Murray.  He has a good article on this in the latest "Claremont Review of Books" called "The Smart Set".

 

Public schools in upper class neighborhoods are completely ineffective in teaching their kids too.  Think "Common Core" etc.  Public schools regardless of neighborhood conduct business to 1) indoctrinate into leftist ideology and 2) make for a cushy life for the union members and union leadership.  Teaching not a priority.

 

Unless you blow up the public schools only in the ghetto and leave public schools in place elsewhere, there would be no gap-closing.

 

And that sounds kind of racist.
