Supreme Court Unanimously Stays Utah Court's Gay Marriage Edict; Orders Appellate Court to Review Question Before Implementing Holding

A Utah court declared -- surprise, surprise -- that gay marriage was now an enshrined right in the Constitution. Nobody's quite certain when this Secret Amendment was passed, but, given the fact the the US system of government is now based on White House statements made during press conferences, it was probably when the doltish Vice President declared that he was "absolutely comfortable" with same sex marriage.

So let it be decreed.

Now the Supreme Court has halted gay marriage in Utah, at least until an appellate court has rendered its own decision.

During the 17 days of the holding, many gay Utahns got married. (I read the number 900+ somewhere but I can't find it now.) Their actual status is now in doubt.

"Clearly, the stay should have been granted with the original District Court decision in order to have avoided the uncertainty created by this unprecedented change," Gov. Gary Herbert said.

Now the state is trying to determine whether the marriages that have already taken place are still valid, Utah Attorney General Sean Reyes said. He said he didn't know when they'd make a determination, saying they don't want to rush an important legal decision.

"This is precisely the uncertainty we were hoping to avoid by requesting the stay," Reyes said. "It's unfortunate that many Utah citizens have been put into this legal limbo."

It was indeed arrogant for the courts to refuse a stay on such a major ruling, on the say-so of only a district court judge.

And how will the appellate court, the 10th Circuit Court of Appeals based in Denver, rule? Well, they sort of already ruled -- three times.

Sotomayor is assigned to the 10th Circuit Court, which rejected UtahÂ’s request for a stay three times.

So that's where their heads are at: They refused to issue a stay, a delay in the execution of the ruling, three times.

Well that and the fact that it is reliably conservative so you have the actions of the judges vs the desires of the population, but that's been pretty standard for the gay marriage issue from the beginning. I'll repeat again that I was once strongly in favor of gay marriage. Then it became clear that it isn't about marriage. My guess is that it will be a situation where churches are forced to either perform the "marriages" or lose tax exempt status. Both of which have always been primary goals of statism. Do I believe that every gay couple have this nefarious plan? No. But GLADD et al? Most certainly. 81 Any of the Monday blues I has melted away with this ruling, yay. So my Monday has not been quite so depressing.

Salt Lake Trib had a dumb article today with people in sackcloth and ashes, bemoaning their marriage might not be legal anymore and that it hurts their feelings. Um, honey? That is not anyone's fault but the judges; for a ruling this big, a stay should have been issued alongside. But the judge wanted the big scene, the flurry of photos and the press, so he got it. You are merely pawns in this stupid game. Photos of the SLC mayor marrying the head of the Utah democratic party to his partner on the courthouse steps mattered more than how this would emotionally throw your fam in chaos. Go whine to the judge, he deserves it.

I am more concerned with some of the smaller counties at the moment, what their fate will be. Obvs the county with SLC started marrying people right away, but others shut their doors at first and either didn't issue licenses at all, or did not issue licenses to same sex couples, until they heard if the stay would be upheld. Lots of same sex couples on the news that night, at those courthouses, very sad pandas. They are going to sue the heck out of the counties, or the clerks there, if the higher courts rule to keep SSM legal, claiming hate. What a mess.

Oh, and they interviewed one person on the news who only wants SSM to be legal in Utah so that she can get a divorce. She went to Massachussetts to get married, then her relationship with that woman ended. Cannot get legally divorced in the state and will not move somewhere else where it can be legal. What a mess times two.

84 I remember a case in law school where the law was plain as day (think it had to do with NY gun laws), but the judge didn't like the law, so held that up meant down. And the people were expected to know that up was down because the judge said so. And the plain and clear letter of the law was no defense to the judge's made up law, which was the law of the land.

Teachers get trained in Utah because of low costs, then get the heck outta dodge and move to a state where they can get paid more. The teachers that remain are either amazing and truly there because they love teaching, or the dregs of the barrel, I have found.

Every year the bulk of our state money goes to education, every time, especially when there is a huge surplus. The teachers unions amass in force to ensure this. Most of my property tax goes to it. And yet K-12 still subpar, . We don't get lotto money and don't have the same kind of alcohol or cigarette tax money coming in as other states. If they would let us drill on our own lands, everyone would be happy to send some of that education's way, but feds say no dice. IDK how to fix it.

A lot of the regional jets which now shoulder a lot of the airline workload are theoretically able to operate at very low temperatures, but the performance tables have not been officially published to incorporate those figures. So, no carrying passengers for regulatory/liability reasons.

They decriminalized it, so bigamy is still illegal but cops cannot arrest a family practicing polygamy. I think ppl are interpreting this as some sort of nefarious way for the LDS church to reinstate polygamy as a tenant of the religion, which, NO. Trust me, as a member no one has plans to go back to that. What it DOES do is free the police across the state from feeling obligated to hunt down those families and prosecute them. Every time they do raids on the polygamist compounds, the press hounds them with photos of tear-stained children being ripped from their families by the cops. Freeing the counties from dealing with this issue and the bad press they get for it, no matter what they do, I think is the real reason, tbh.

I have listened to church leaders talk about this. On the one hand, churches are by their very nature borderless; the focus is on spreading the gospel, not caring where you have come from. With a missionary on every block in Utah, it is easier to preach to illegals here than to do it in their home countries, so making illegals feel safe to move here, from a gospel standpoint, is appealing. On the other hand, one of the Articles of Faith of the LDS states that members believe in being good citizens, "obeying, honoring, and sustaining the law." Sheltering illegals goes against that tenant. How certain political leaders in the state that are LDS do not see the hypocrisy of changing laws for illegals, while refusing to do so for gays, I do not know.

At a nearby university, to use their alumni center for your reception you HAVE to use their on campus catering. It is a requirement to rent the space if you plan on food. I could see the churches maybe doing that for weddings. Want a wedding in our church or reception hall? Use one of the approved Christian caterers on this list we will provide for you, otherwise please find another location. A Utah court's decision would eventually go to the Utah Supreme Court, while the federal district court's decision would go to the Tenth Circuit. While I certainly wouldn't make any guarantees, I'd be really shocked if the Utah Supreme Court upheld this ban, so it was a smart strategic decision to bring the suit through the federal system instead. Of course, the US Supreme Court has jurisdiction over both, so there's a pretty good chance this would (and probably will) end up there either way.
