Ted Cruz: Obama Should Use State of the Union Address to Apologize to America for Obamacare "Lie of the Year"

“For the State of the Union, one of the things President Obama really oughta do is look in the TV camera and say to the over 5 million Americans all across this country who've had their health insurance canceled because of ObamaCare, to look in the camera and say, ‘I’m sorry,’ ” Cruz said on CBS’s "Face the Nation."

Obamacare meanwhile is at its lowest support ever according to a FoxNews poll.

A record high number of voters now oppose the 2010 Affordable Care Act and a record low number supports it, according to the latest Fox News poll.

In addition, a majority thinks the new law will increase their health care costs, while few think it will improve their quality of care.

The new poll finds 59 percent of voters oppose the health care law, up from 55 percent who opposed it six months ago (June 2013). The increase in opposition comes from both independents and Democrats.

Nearly a third of Democrats -- 30 percent -- oppose the law, up from 22 percent in June.

Opposition among independents went from 53 percent to 64 percent today.

Overall, 36 percent of voters favor the new health care law. ThatÂ’s down from 40 percent in June and marks a new low.

Glenn Reynolds writes of "Irish democracy" in his USAToday column -- killing a law by passive resistance to it, or even active flouting of it. He quotes James Scott to explain the principle:

One need not have an actual conspiracy to achieve the practical effects of a conspiracy. More regimes have been brought, piecemeal, to their knees by what was once called 'Irish Democracy,' the silent, dogged resistance, withdrawal, and truculence of millions of ordinary people, than by revolutionary vanguards or rioting mobs.

Retiring liberal Congressman/longtime bilious psychopath Jim Moran confesses that just that sort of passive resistance, among the young especially, is undermining Obamacare. Or, as the American University radio station he gave the interview to puts it, it could "unravel" the system.

“I’m afraid that the millennials, if you will, are less likely to sign up. I think they feel more independent, I think they feel a little more invulnerable than prior generations,” Moran says. “But I don’t think we’re going to get enough young people signing up to make this bill work as it was intended to financially.”

If MoranÂ’s prediction is correct, the whole law could unravel. He says there just isnÂ’t enough incentive for healthy young people to sign up for insurance.

“And, frankly, there’s some legitimacy to their concern because the government spends about $7 for the elderly for every $1 it spends on the young,” Moran says.

Megan McArdle notes that Obamacare has been most effective at signing up people who already had insurance. That is to say, who previously had insurance, but Obamacare cancelled it. And of those folks, Obamacare has actually managed to sign up... 75% of them.

So of the people who previously had insurance, Obamacare has only taken all insurance away from 25%. The rest have more expensive, worse coverage through Obamacare.

That's a big win, I guess, relatively, compared to the other numbers. Obama's Big Win consists of reducing the insured rate of a group by a mere 25%.

But what about the uninsured, the people for whom we're making all these sacrifices?

Of those, Obmacare has enticed... 15% to sign up. 85% of the previously uninsured remain uninsured.

What possible economic sense does it make for a millenial to purchase an insurance policy with a $5,000 deductible unless that person is purposefully buying a catastrophic insurance plan? I vaguely recall that the first few health insurance policies I bought right out of college were cheap but that's because they were get hit by a bus plans, not allegedly comprehensive care plans. Also, no one made me buy them.

We canceled our California insurance and moved to Texas a month early to get a starting date of December 2013 on our new insurance, just to put off having to deal with the exchanges for a year. Currently, even if there is a sweep of the Senate and the House big enough to override Presidential vetoes, we’ll still be out of luck until those bodies reconvene—and lets face it, that isn’t happening.

It has not been well remarked that here in northern Commiefornia, Rep. George Miller, who has been in Congress since the Nixon years as part of the first wave of liberal baby boomers into those seats, is pulling the ejection seat handle and retiring.

The significance of this is hard to overstate.

Miller comes out of the same ruthless regional "Burton machine", named after the eponymous Burton brothers, both very greasy liberal pols, through which Nancy Pelosi came up. Miller has been an absolutely unswerving Pelosi ally and his seat is still at least notionally quite safe thanks to gerrymandering.

So when a guy like that takes to his heels, you know there is major trouble brewing for liberals on Capitol Hill. You can also infer that Pelosi is shipping water over the gunwales with the rank and file, who are probably ready for a change of leadership by now.

So there are plans where you're out $10k before a penny is picked up by insurance. Which, again, is fine. If I were between jobs then I wouldn't have a problem buying a catastrophic coverage policy because that's what I need right then. But these are not being sold as catastrophic but rather comprehensive plans. Previously, insurance commissioners would be going after companies who did this with all diligence for bait and switch advertising.

Due to the large number of Medi-Cal applications received through the Covered California website, the Department of Health Care Services (DHCS) will provide temporary Medi-Cal eligibility for many individuals and families while their applications are being verified. This temporary coverage, called presumptive eligibility, will allow adults to receive Medi-Cal coverage through the 8E Accelerated Enrollment aid code starting January 1, 2014, while their applications are being verified.

Just a guess here, but the total OPX (deductible + coinsurance) on a 5k deductible is probably $7500. That's pretty normal. Further, while HDHPs are good for some- they are typically NOT for those who were uninsured. Especially those who have "pre-existing conditions." The concept behind the HDHP is that the lower premium (ha! 404Care screwed that up, too) would be used to put money in your HSA. After *several years* of that, you'd have plenty of money in your HSA for medical calamity. If you have that medical calamity in the first year or two (or if you come pre-calamitied)? Not so much.

This is more public relations than substance on Cornyn's part, but still. It shows that he was unsettled by what Cruz pulled off.

My policy wasn't cancelled but I was given the privilege of now having a 500 co-pay on everything except basic doctor visits  whereas in the past it was 0.   Oh and I forgot.   A 50.00 co-pay on medication.

I signed up for the catastrophic health plan with my company insurance last year. It had a $5K floor you had to meet and then it covered 100% of all "covered" expenses after that.  We met our $5K about mid Feb.  That was the best plan for us.



We signed up for the same plan this year.  Thanks to Obamacide it costs more than double, it only covers 80% of covered costs, and it has a $10K out of pocket.  


And I am afraid when the employer Obamacide kicks in I will lose it all.

So you pay your full deductible, then coinsurance kicks in at x% (as low as 60 for the bronze plans- meaning you're paying 40% of the bill). Once that 40% you've been paying PLUS the deductible you already paid equals a certain amount, then you've hit the Out of Pocket max. But also remember that OPX does not include "non-covered charges," "out-of-network charges," and a host of other things.

Plus, no one is really clear yet if I can still use the same doctor. The best answer I got was "try it and see" hahaha. But! I pay $150 less a month for my premium. The only issue I'd take with Glenn's article is that he mistakenly asserts that the Supremacy Clause prevents the states from nullifying federal legislation.

 

This is untrue.  The actual wording of the clause only applies to federal laws that are made pursuant to the Constitution.  Those that are not are null even before a state or several states act to make it official.

 

At least that's the way it should be.

 

So far, nullification has only been tested a few times.  It failed largely because of the threat of federal armed invasion.  I doubt the federal government would have the courage to actually try to invade a state for nullifying illegal laws like ObamaCare or the war on (some) drugs.

 

It's also about time we lower the curtain on the whole "judicial review" experiment, as well.  The SCOTUS does not have the authority to declare illegal laws to be constitutional, depending on who gets to pack the court with their appointees.

At some point conservatives are going to wake up to the fact that Fox is an echo chamber of stupidity that garners around a million viewers for its most popular shows. In comparison even the unpopular CBS Evening news gets 8 million viewers. Before Fox News existed between between 1952 and 1988, Republicans won 7 out of the 10 presidential elections. Since then the Dems have won the popular vote 5 out of 6 times. Roger Ailes cares only about his bank account. His brand of stupid TV has done unimaginable damage to the GOP's chances of winning presidential elections. It now has a median viewer age of 68 years according to Nielsen data through mid-January. It's little more than a Stockholm syndrome retirement community.

Long time reader, first time poster here.

Had to comment about Irish Democracy.  I love this as it has been exactly my personal plan.  I have been uninsured my entire adult life (I'm in my 50's now) and instead paid for all of my medical needs in cash.  Needless to say, this makes one very careful about their person.  Silly personal responsibility.  P.S. I've saved a ton of money over 3 decades; premiums vs. my actual costs.

Anyway, I never intended to enroll in Obamacare.  I'm self-employed, so pay estimated taxes quarterly with never a refund.  No refund, no way for the gov't to deduct the penalty for lack of enrollment.  I'm selling my house and completely revamping my entire financical situation and lifestlye.  Going Galt, in a way.  My attitude has remained the same since the tragic night that they passed this terrible bill; Come and get me.

Had never heard the term Irish Democracy 'til now.  Love it!  I'm of Irish descent, so I'm feeling even better about my plans.

We have to remind ourselves as often as possible that we the people hold all of the power.  The Constitution, our numbers and 300+ million privately owned firearms means we can do as we please.  I don't fear government, they should fear me.
