1 Good Morning Morons.  Today is Tuesday, January 28, 2014.  And in keeping with our impending snowmagedden today we have this for our day in history.  On this day in1887 in a snowstorm at Fort Keogh, Montana, the world's largest snowflakes were reported, 15 inches (38 cm) wide and 8 inches (20 cm) thick.  They are predicting a high today of 32F and the snow to start around noonish (however the high will have already occurred at midnigh when it was about 45F).  But we haz global warming.

3 Pharaoh Obama Seti I will use an illegal executive order to raise the minimum wage of federal contractors to the Democrat desired $10.10/hour.  If I am not mistaken federal workers, including contractors, minimum wage is set by an Act of Congress and it is tied to the prevailing wages of the area.  Fox/AP here says he doesn't have the power to arbitrarily raise private worker raises.  Well he doesn't have the power to raise federal workers either.  When is Congress going to reign this corrupt SOB in?

Those who can demand more because they have some talent, some skill, some experience, some tool who can demonstrate some ability will get more than the minimum.

The entire time  was growing up my home county was dry.  When I got out of the Navy and went home for a while they had gone wet.  My brother told me the three major churches in the county  had all changed out their preachers at the same time and while the pulpits were empty the country passed an ordinance to lift the ban on liquor.

The FAR, like any other regulation, is a minimum standard. There is nothing to prevent more stringent requirements at the behest of the Agency Director. Or in this case, the president.

 

Example: The EPA has minimum vehicle emmision standards established. The President (I think it was W.) enacted an Executive Order mandating that all Executve Branches (including DoD) must abide by a higher standard with the exception of tactical vehicles.

Originally, I was very fond of Palin. She seemeed to exude authenticity and honesty.

 

As the campaign wore on, my like for her waned. She kept repeating the same lines that were refreshing the first time or two, but became hackneyed and stale. Like a comedian who gets a laugh with a joke and then continues to repeat the punch line over and over hoping to get the same results.

 

After the campaign failed, I wanted here to stay away. Not because she is a bad woman or would be a bad politician, but because she seems to have grown too enamored with herself. Every thing she does anymore seems to be centered around gaining or keeping publicity for herself.

 

She has grown much too fond of the lights and cameras I think.

It was bugging me so I went to look it up.   I'm looking at subpart  22.10 where it's applying The Service Contract Act of 1965, under Statutory Requirements.

 

There's language in there under Statutory Requirements (22-1002-2) that says:

 

"Contractors performing on service contracts in excess of $2,500 to which no predecessor contractorÂ’s collective bargaining agreement applies shall pay their employees at least the wages and fringe benefits found by the Department of Labor to prevail in the locality or, in the absence of a wage determination, the minimum wage set forth in the Fair Labor Standards Act."

 

It's further hammered home in 22-1002-4:

 

"No contractor or subcontractor holding a service contract for any dollar amount shall pay any of its employees working on the contract less than the minimum wage specified in section 6(a)(1) of the Fair Labor Standards Act (29 USC 206)."

 

So in my reading at least, arbitrarily changing the standard at the executive level doesn't sound right to me.

I should have also added that the authority for the Federal Acquisition Regulation comes from the Office of Federal Procurement Policy Act of 1974   (41 USC 425).

 

I don't see a section that says the Executive Authority has the ability to just raise a wage, especially given the language in 22-10.

.He isn't raising anything.  There isn't a single Federal Contract worker who makes $10 bucks an hour.  When I retired we had almost 60 contractors working with us as Clerk Level I.  They started at $14 an hour.  The Level II Clerks made almost $16 IIRC when they started.  Almost everyone who worked there was entry level and making double the current minimum wage and well over this "raise".

Contracts given to vendors through the SBA or 3PL frequently have higher standards as well.

 

Congressionally mandated (or "advised") purchases or service contracts also frequently have higher than minimum requirements in order to satisfy their pet project or cause.

 

I'm currently managing a program that has standards much higher than the governing Agency's regulations as a direct result of Executive Order.

 

It happens all the time. The thing to keep in mind that the regulations and statutes have minimim standards. The Executive can go above and beyond at any time so long as the minimum is maintained.

As long as the minimums are adhered to, they are abiding by the FAR.

 

I'd have to defer to a JAG or one of the lawyers here for the legal points of order. But from my experience in the logistics and acquisitions arenas, Executive Orders have been used to increase the requirements in performance, pay, and timelines above and beyond what is contained in the FAR.

 

I'll offer the caviat that I don't have the expertise to determine the legality of such action, and I'll have to give that aspect to better than me to pontify on. But from personal experience, it DOES happen.

216 Grammie Winger, well propane company finally visited house yesterday to check on heater after I had called them on Wednesday.  The heater is bad, emitting carbon monoxide like Gaylord spews in front of the TV.  So as it snows outside I stay warm with electric heaters and very bundled up in layers of clothing.

I'm more referring to the statutory authority of an agency to demand something that's higher than what the FAR identifies.  In other words, the FAR says if I don't pay at least the minimum wage, my bid will be denied.  Fair enough.  But then I'm being told an Agency can arbitrarily set its own wage floor and deny contracts that are compliant with the FAR but not compliant with the Agency's demand.  That's the part I'm having trouble with - where's the authority for an Agency to set that new minimum standard?

 

On the other point, I'm quite sure EOs have been used thusly before, and they will likely be used again, but I don't think that's an argument as to whether it is statutorily kosher.

Today is the 28th anniversary of the Challenger disaster. Surprised Vic didn't mention it, but I think we should remember and honor those lost souls.

 

I've told the story before, but I was 6 at the time of the Challenger disaster.  Since Christa McAuliffe was from NH, pretty much every TV in the state was tuned to the liftoff.  I was lying on my stomach on the living room floor in front of our    TV watching it go, and I remember when it split apart and    the picture changed to those two curling smoke trails.  I didn't know anything had gone wrong so I kept watching.   It's so crystal clear in my memory, watching those bits of debris fall through the sky   and    not knowing what it meant.  It makes for a very strange, sad memory.

I was finishing up a job and missed the liftoff. Then I heard the cries coming from the bosses office. Schools all across America had it on TV because the flight had the schoolteacher Christa McAuliffe, the first civilian astronaut. TVs in schools were rare then. What an awful tragedy. President Reagan was magnificent when he addressed the nation.

Price of propane is now running $3.55/gallon when just a few months ago it was under $3/gallon.

Now I get to wait and see if I get another bill in the mail.  Had called them once before on this heater.  They came out and cleaned it and did leak test.  Everything seemed okay until a few hours after they left.  And the smoke alarm went off.  So another service call and this time, after I requested them to bring a CO monitor, guess what the heater is bad.  *thud*

299 Artisanal'ette, The Dude was talking about that battle on the ONT. I think he quoted a $300k figure for the cost of the fight. Too bad we can't get Iran to fight the US on the EVE servers. And, it was triggered because someone didn't pay a bill on time. lol It's been ongoing, of course, but, this triggered the massiveness of the cost and fight so far. I can understand when the president is a decent man but this one is an embarrassment to the United States. Someone couldnÂ’t pay me enough to have my picture taken with him. I would only do it if I could take only the money to try to have my now quadriplegic brother moved from Maine to Massachusetts and to try to rehab him. I would take the money but only to help him because heÂ’s helpless now. Friday it will be ten months since he got sick, it started with a strep infection.
