2 Good Morning Morons.  Today is Friday, January 03, 2014.  On this day in 1521 Pope Leo X excommunicated Martin Luther.   And all you Morons living in the NE, let's be careful up there.  Even down here in SC they are calling for a high of only 37° today.

But Rome wasnÂ’t built in a day, and Detroit wasnÂ’t destroyed in one either.

No Detroit wasn't destroyed in a "day".  But that was only because they received massive amounts of federal taxpayer money to keep them afloat.  And they are STILL getting this money. W/O that continued bailout they would have gone under long ago.

26 Thanks for the video, Gabe; It's fun and they sing very well. I have to say my taste in music is more in line with the men singing in the clip I have below, but I'm and old geezer and prefer church music. :^) Have a great day. I appreciate your contributions here. Thanks to you too, Vic. Too bad you can't get paid for all the work you do here. :^) Great hymns of the faith-Perhaps a lesser known hymn to some people, but a beautiful and appropriate one for Epiphany- "O, Morning Star, How Fair and Bright" with words by Phillip Nicolai and music by J.S. Bach Philipp Nicolai, a pastor in Unna, Germany wrote this hymn during an epidemic of Black Plague that was devastating Europe. His parsonage overlooked the graveyard where hundreds of plague victims were being buried -- as many as thirty in a single day. It was out of this context that Pastor Nicolai was inspired to write this hymn -- a hymn intended to convey the hope of eternal life. The words of the hymn were altered substantially over the years, but retain their emphasis on Christ and the eternal life that he offers. The first verse honors Christ -- referring to him as the Morning Star -- the Sovereign -- and the Root of Jesse. The second verse celebrates Christ as light shining to brighten our darkness. O Morning Star, how fair and bright thou beamest forth in truth and light, O Sovereign meek and lowly! Thou Root of Jesse, David's Son, my Lord and Master, thou has won my heart to serve thee solely! Thou art holy, fair and glorious, all-victorious, rich in blessing, rule and might o'er all possessing. 2. Thou heavenly Brightness! Light divine! O deep within my heart now shine, and make thee there an altar! fill me with joy and strength to be thy member, ever joined to thee in love that cannot falter; toward thee longing doth possess me; turn and bless me; here in sadness eye and heart long for thy gladness. The third verse celebrates the hope of eternal life: What joy to know, when life is past, the Lord we love is first and last, the end and the beginning! He will one day, O glorious grace, transport us to that happy place beyond all tears and sinning! From Lectionary. org-Richard Neil Donovan. This is a beautiful version by a church mens group of only the first two verses: http://www.youtube.com/watch?v=c2Vs2UxS5PE "Some scholars consider the reference to be to Christ himself. Professor Andrew Hill has written: “Jesus Christ is described as the ‘morning star’ in 2 Peter 1:19 (phosphoros) and in Revelation 2:28 (aster proinos), and He identifies Himself as ‘the bright morning star’ (ho aster ho lampros ho proninos) in Revelation 22:16” (413). He goes on to point out that this “star” symbolism reflects the Old Testament and inter-testament emphasis on the “celestial” nature of the coming Messiah (cf. Numbers 24:17; Malachi 4:2). William Barclay, the great writer about Scripture suggested several ideas. He thought the expression could signify the coming resurrection of the righteous. Just as the “morning star” breaks forth from the darkness of night, so the Lord’s people will break out of the darkness of the grave (1957, 67). Later, however, he came to a different conclusion. He was “quite certain” that the “correct interpretation” is this. The “morning star” is Christ himself. “If the Christian is true, when life comes to an end he will possess Christ, never to lose him again” (1959, 140)." Wayne Jackson Keep on praying!

51 It's not just the appeals that drags these cases out (although there should not be automatic appeals IMO).

It's the amount of cases ahead of them that takes up the time.

a first time appeal of a death sentence can take up to a year before anything is done before a judge. Sometimes 2 years.

Then there's pleas and counter pleas and introduction of evidence and all those have to be done before a judge and may take a year for each one to be processed. Then after rejection of the final state appeal, it may then go to the Federal District court (if sufficient constitutional grounds can be shown) and on to the Supreme court also.

Figure it take no less than 3 months to get an appearance usually 6 months to  a year.

Multiply that by myriad pleas and hearings and it's not surprising it goes 20 years. It's a game to those who play the part of justice. They think they're doing good but they're just wasting time and money mostly.

57 Luther did not come out of a vacuum. There were other reformers before him including John Wycliffe and Jan Hus-who was a Priest who was executed for his reformist views. Yes, there might have been another Luther but he was brilliant and impassioned and protected by powerful friends. Luther had some definite deficiencies. He was anti Semetic (not at all unsusual for the time, sadly) and hated the Anabaptists and didn't mind them being persecuted and well as his oddities one of which Conservative Crank (who doesn't seem like much of a crank to me . :^) already mentioned

I don't think they have automatic pleas.

See that's where it gets all cloggy. guy gets told he's getting an automatic plea. Since it's mandated, the State picks up the tab for his lawyers (unless he's got money).

I assume in Tejas they don't do that and so the road to justice is straight and narrow and the posted speed is 75. YEE HAA.

I think they do it the right way. However, that said, they're are a lot of bad prosecutors out there and many of them proven to be in Tejas. They've hidden evidence and witnesses that would've exonerated defendants. So I have mixed emotions about the death penalty being so quick without oversight of the process.

With professional crime labs and a tight rein on DA's the process can be fast and fair.

No. but keep in mind. we see those times through the filter of another's view and it may be distorted or truncated.

I'm sure it looks like things worked better then but I'm sure that humans still sucked then as they do now so it can't have been all that good.

plus there's the limited life span and lack of antibiotics and basic hygiene.

Hobbes once said ""In such condition there is no place for industry, because the fruit thereof is uncertain, and consequently, not culture of the earth, no navigation, nor the use of commodities that may be imported by sea, no commodious building, no instruments of moving and removing such things as require much force, no knowledge of the face of the earth, no account of time, no arts, no letters, no society, and which is worst of all, continual fear and danger of violent death, and the life of man, solitary, poor, nasty, brutish, and short."

That's how I imagine things were like. they looked good to the people living then because the alternative was grubbing in the mud and being eaten by dogs.

120 It gave me some satisfaction when I visited the large cathedral in Cologne Germany to see the start and completion dates carved into blocks.  They were hundreds of years apart.  Some of the delay was because Martin Luther dried up their indulgence money.  --That will teach them to burn the 95 thesis in Cologne.

When I stood there I guess I could of thought "how beautiful" but instead I was struck by the heavy hand that must of been on the hearts of the people and what it meant to stand against it.  Gutenberg figured out to print, but there must be some unknown blacksmith that invented the CNC machine, because Luther had his manly parts made of titanium.

I covered that last year on this date.  There are a lot of stories about that accident.  The official version is they were pulling a control rod by hand with a rope.  There are no "interlocks" or safety features in your hand.  The investigation postulated that they pulled the rod too fast and the reactor went prompt critical in that one fuel channel creating steam explosion.  The steam explosion ejected the rod from the core impaling the guy who was pulling the rope and pinning him to the roof.  The other two guys died from radiation overdose.

Yeah I use the impaled rod guy as a cautionary tale to my son about bringing anger to a precise task.

You and I had a discussion about the sanity of having your poison be essentially glued on to rods that were subject to the conditions of the reactor vessel on a recurring and far more frequent than field use would have mandated degradation cycle.

The idea probably could have worked, but I suspect that it would have been a lot like the Texas Towers a solution that would have been exerted on a problem with a short half life.  The problem the SL-1 reactor was trying to solve was stable self contained power for the Dew Line.  The Dew Line was largely replaced with more mobile platforms within 15 years.

I am in awe of the old proving grounds in Idaho Falls and our can-do attitude.

There was nothing wrong with the control rods.  They were made of cadmium clad in aluminum.  The problem came from the people pulling the rod by hand without a good grounding in the effects of rod motion in adding reactivity.

In both cases there were prosecutors who ran amok and people who interceded to help them; Dorothy Rabinowitz in Fells Acre and KC Johnson in the Duke hoax.  Yes it's a good thing that the Duke students were able to afford excellent legal counsel to keep them from enduring what the Amiraults did before Rabinowitz's articles spurred some attorneys reading it to do pro bono work on their behalf.  Kudos to North Carolina's State Attorney for issuing the highly unusual ruling that the accused just weren't not guilty and some people might think they got away with something (not that fucking shit for brains dimwits won't think that anyway) but they were in fact innocent of all charges.  Contrast that to the dumbass Choadley in Mass who dragged her feet as long as possible on delivering justice to the Amiraults.  Fortunately Scotty Centerfold was able to use that against the ignorant scrunt, who was borderline retarded on other things as well.

The instructors gave testimony that the manipulation of the rods degraded over the service life of the system.  I was not saying that the rods themselves had lost all of their reaction poisoning potential, but I was saying that the engineering solution chosen was "interesting" which you seem to agree with. If I remember correctly in shrinking the core form the initial design Combustion engineering did not even use the outer 4 control rods, resulting in procedure that had an undue amount of reactivity control placed on the central main rod.

The primary cause was as you state the lack of understanding about tolerances on the part of Specialist Byrnes.  The difference in skill level and technical aptitude between Combustion Engineering and the Military's Nuclear Program Technicians was pretty profound.  Add in an allegedly hotheaded E-4 with no respect for the CE procedural protocols and it was a crisis in waiting.

It is also pretty apparent that the SL-1 project was sort of in an administrative limbo with Combustion Engineering and the Army not engaging in proper oversight roles of their respective missions on the project IIRC.

It's been a few years since I really went over the data, or read the book that contends that Byrnes and Legg had some pretty intense extracurricular rivalry going on etc etc.

Have always meant to ask you since you were in the business direct if you felt that there was potential in that family of solution from a practical standpoint with refinement.

It did not produce a lot of power relatively speaking when under control, but removal of the "magic 4 inches" of human only control would have allowed it to operate safely at a cost of some compactness.

It is humbling to think a 3d of a foot tolerance unleashed when exceeded within the human span 20 GW energy in 4 milliseconds or so.

165 Sven, I believe C J Roberts was bribed. I'm using iPad now, but I have original ruling saved on my laptop & it's clear Roberts changed his mind at the last minute. I never heard why, but sometime in late summer or early fall a man called local radio show host in Boston, Howie Carr & said Roberts adopted Irish children illegally. Their law is that the adoptive parents are Irish citizens & it must go through Ireland's court. Roberts had two pregnant women go to South America to give birth to them. Howie cut man off because he'd never heard it & didn't want to start rumor. After one or two commercial breaks, he said that it's all over the internet. Roberts lied on bar test, etc & he should have disqualified himself from being on SCOTUS. I have website saved somewhere on my computer. Do a search about Roberts adopted Irish children & you'll find it.

I'm torn on this.  There are some people who just deserve to die and the world will be better off with them gone.  Period.  That said I'm still mystified with how anybody on that jury in Fells Acre couldn't see through all the horseshit recovered memory nonsense and realize there wasn't a damn bit of physical evidence that anything wrong happened.  The jury system sometimes breaks down.  Fortunately that wasn't a death penalty case; although any time an innocent person goes behind bars that's bad enough.

When I was in school we covered that accident in detail.  There are a few minor differences in the details on what we covered and what is in Wiki.  Wiki says that the criticality was caused by simple withdrawel of the rod and that is true.  However simply going critical under those conditions should not have caused a steam explosion.  The information I got was it was a combination of the distance the rod was withdrawn and the rate at which the guy withdrew it caused it to go "prompt critical" (sometimes called super-critical which is not technically accurate).

But one thing to keep in mind, since everyone who was there died they really can not be sure exactly what happened.

Another thing that is ironic about this accident is that due to that reduced size design the reactor could go critical on the withdrawal of that one rod.  That has always been prohibited in all naval reactors and civilian reactors.

177 Regarding the Daily Mail story about people being turned away for medical treatment: 1) Under EMTALA (signed into law by Reagan, one of those hateful republicans who don't care about the poor or the sick), no one can be turned away for treatment in the US, regardless of ability to pay. So does the ACA make EMTALA null and void? I know dems (including obama) were saying there would be no "free riders" under the ACA, but EMTALA isn't necessarily a free ride. 2) We've now seen that Medicaid payments aren't being made to the hospitals, which in turn is causing the hospitals to be unable to meet payroll in some cases. obama has asked the insurance companies to go ahead and cover the costs of people who show up to the doctor or the hospital and claim to have signed up -- whether paying for private insurance or getting expanded medicaid coverage. So is obama expecting the insurance companies to basically float the fedgov a short term loan by paying for the Medicaid people's medical costs? 3) Which obama/dem cronies got the sweet, sweet taxpayer money for creating the third party accounting and billing system which is supposed to cover the Medicaid payments to small hospitals that isn't working? And why did that company get an emergency "no-bid" contract when they clearly aren't capable of delivering a working system?

186 Prompt Critical is not a documentary, nor do I entirely believe to certainty that Byrnes intentionally caused the meltdown, but he did have a record of violating procedures.

There is also the official film on the incident.

http://youtu.be/qOt7xDKxmCM

SL-1 (1961)

of interest is that the investigators concluded that Byrnes extracted the rod 26 and a quarter inches which I do not think could have been done "accidentally" if the activity was being treated with proper respect.

One other point of interest is the success of the design in containing the majority of the radiation release despite the lack of a modern understanding containment vessel.

A lot was learned from the incident, and I have seldom felt the need to watch horror flicks for horror after I read the reports of the autopsy protocols as a young man.

210 I wasn't talking about the 1970s, nor of thugs. I was actually thinking of James Hanratty and Timothy Evans. To me, the DP is such a finality that it should be applied only in cases of obvious, provable overwhelming guilt. Posted by: Mary Poppins' Practically Perfect Piercing at January 03, 2014 08:16 AM (zF6Iw) Why would something in another country that happened over 50 yts ago have any bearing on our judicial system? In this country, the DP isn't even applied that often. And then they receive 10-40 years of appeals. Those are UK cases -- old UK cases. Most of the reporting on US capital cases is biased. Both the msm and groupies just out and out lie about the evidence. So, it may seem that there is not obvious provable overwhelming guilt but there is.

They'd probably be in the playoffs now if they'd have stayed with Slingin' Josh McCown instead of that interception machine when he came back from injury.  At least enneffell contracts mean nothing over the life of them if you get cut.

214 198. MP4 I am no bleeding heart on the death penalty. That said, I agree with you. The public is TOO GULLIBLE. Not everyone, but people do get framed all the time by corrupt officials. Those cases get discussed here regularly. Over zealous prosecutors. Fraudulent prosecutors. Zimmerman bell ringing the alarm. And these days, we aren't simply facing a few corrupt officials. Our entire government has been corrupted. Too few hold the line of constitutional integrity. And fabricating evidence is easier than ever for those with opportunity. Bureaucracy works against the citizenry. Even when fraud is exposed, "That happened a long time ago. At this point, what difference does it make?" is the standard official policy for perpetuating injustice and dissolving rule of law. It isn't just "this" administration, "this" Congress, or "this" Chief Justice.

As a believer in State's Rights, I certainly have no problem with CO giving this a try. Let them be the self selected guinea pig to test this out. If it works, other States can see if they do or do not want to follow suit.

I'm a conservative with libertarian leanings.

I support drug legalization with even less reservations than I once had, and I support prostitution being legal and subject to regulation by local forces.

I think people should be free to exert their will on their legally gained lands and property with the minimal amount of regulations necessary to prevent catastrophe to the commons.

I believe people should be free to say what they will as sunlight is the best disinfectant.

I also have a slightly more nuanced order of goals than "I wanna spliff up right now man."

CO will try to do away with pre-employment drug screening before they allow more gun freedom or economic liberty.

266 I've waited years for repeal of beer prohibition. There is no justification for such Puritanical nannying. If your behavior shows you can't handle beer, your behavior crosses criminal lines, you are directly responsible, not some other beer drinker. It has always baffled me that conservatives practically celebrate marijuana use, woven deeply into their culture, despite its proven deleterious effects, yet stand with such 'moral' authoritarian opposition to a soft drug like beer. Furthermore, where beer is, gradually, finally, being legalized for adult manufacture, sale, and consumption, we still see the Nanny authoritarianism in regulations and taxes, suggesting we may have beer by the State's permission, rather than by God-given liberty. I'll bet in all the multiverses, there is some parallel world where conservative principles consistently recognize that government has no business in such personal behavioral taboo enforcement. Even for beer.

262: "....i have a hard time believing that drug cartel activity (murder, kidnapping, beheading, shootouts, home invasions) will magically disappear..."

I don't disagree with you. For me it is a "what if" kind of thought. I think the reason the cartels can get away with that kind of shit up here is there is no one for the pot growers/dealers to go to when faced with a cartel push.

Making pot a legal commodity would allow the locals to appeal to the city or state police for protection and action. How much protection the police would be able to provide is debatable.

The example I draw from is the comparison of violence during prohibition of alcohol and its drawdown after prohibition ended. Sure the gangs were still around and violence occured. But at nowhere near the same levels.

Whether this same dynamic would occur in the pot trade remains to be seen. I guess the only way to tell is to count the bodies after the snow melts.

It was in the way of being a rhetorical question. See, it's the one thing pot smokers (in general, at least) won't talk about. Even the ones who do talk about it can do so safe in the knowledge that we'll never actually force them off the dole for being pot smokers. But, yes, let's say Texas had pot legalization on this year's ballot. If it said, "Oh, but you won't be eligible for any State assistance" I wouldn't vote against it (I probably wouldn't vote at all on that issue). If that part were left out, I would vote against it. I'm fine with treating adults like adults- but that means letting them face the consequences of their own actions.

Readers, keep the auto-response to yourselves and consider well how our trust and best intentions for "world peace" via biggest military big stick enforcement of loudest voices (nothing nuanced!) have been twisted, leaving us bankrupt financially, personally and nationally, leaving us bereft of liberty with our inalienable rights DENIED by the very constitutional government founded to PROTECT ... ...to which neoconservatives have certainly burgeoned US fascism since Eisenhower's departing admission of guilt, via interventionist wars gone insanely suicidal (national policy, "We came. We saw. We killed. Bwahahaha" motto through the never ending wars fought by enlisted troops perpetually redeployed, survivors coming home to cut benefits. And more "in your face" US fascism via the Patriot Act, DHS and whatever new mutant head or horn emerging from that beast. Don't go stupid and misrepresent the obvious. Eisenhower did his best. But even he was duped into thinking only through his own administrative period, how to deal with all the problems facing our nation. And he did his best. Build infrastructure, keep taxes low, cut military via utilization of CIA special ops (AJAX, etc). Unfortunately, those who advised him had their own agenda to monopolize power and usurp authority, transforming our nation into another empirical authoritarian regime, sucking us all bone dry over the decades. Patients in a close-in DC suburb who think they've signed up for new insurance plans are struggling to show their December enrollments are in force, and health care administrators aren't taking their word for it. In place of quick service and painless billing, these Virginians are now facing the threat of sticker-shock that comes with bills they can't afford. 'They had no idea if my insurance was active or not!' a coughing Maria Galvez told MailOnline outside the Inova Healthplex facility in the town of Springfield. She was leaving the building without getting a needed chest x-ray. 311 Of course a federal court had to stop that even though they should have had no jurisdiction in a State welfare case. Here's what I don't get about that one. Drug use is illegal in the US. Period, full-stop. By current supreme court "precedent" (spit), that means it's not even legal to use in Colorado. So if it's illegal to use drugs, why should a state be prevented from checking for drug use prior to allowing someone to be eligible for state welfare? I don't even see how that reasoning even sort-of works.

For one thing, health insurance through the exchanges seems to be fully of the "High Deductible Health Plan" variety, which means everything goes to deductible first in the first place. For another, if the doctors thought it was serious enough to admit her, they wouldn't have said "it's up to you," (though that's not a quote, so they *might* have said, "we can't make you stay if you choose to leave..."). 334 Sounds very Genghis Khan, doesn't it? Sounds like the leader of Korea who ordered i deserves hell. I don't wish that anyone goes to hell and don't rejoice over people being there, but that is beyond disgusting and cruel and so evil. I guess I need to pray he and the people who did it have a conversion experience and that God might have mercy on the people executed.

335 334 Obama's approach shot landed short of the green. He putted it on, then missed his putt from the green about 2 feet left of the hole.....

336 307. The people, ESPECIALLY WASHINGTONIANS, are already drugged out of their sensibilities. McCain, Obama, Hillary and Kerry are prime examples. As if mood enhancing pharmaceuticals don't already pump through the entire generation now in college, now in the work force, from birth into adults, inviting middle aged and seniors into the ranks, prescribed by physicians. Now? ACA

It's how state run media in an autocracy rolls....

well scratch that they are not yet to the point they are reporting Obama's drives can be used to test NORAD like the reporting on Kim Jong Il in Ping Pong but give it time.

338 So, it looks like we've already had the first SMODlet of the year: http://tinyurl.com/o5unhhw Sure, it was only about 6-8 feet across, and it burned up west of Africa, but maybe it's just a test run...

Sounds like your day has started off swell there MWR. Hope it gets better. Right now about 28F and its supposed to warm up.

I YEARN for 28F.    *sigh*   Right now it's a toasty 4F here in Concord.    Of course the windchill puts it down around -11F.   But it could be worse!

Be calling a technician today, seems igniter for propane heater is going out. Which means the lit heater will go out with valve open. Hence I think why my alarm system freaked out earlier. Oi.

I agree!    In fact, they should have to walk MY dog when it's this damn cold.  And I don't have a dog.  I will go out and GET a dog just so those fuckers have to walk it for me.

350 MWR, thanks.  I called the propane company for a service call.

They said they could send a technician out in  ->  #two weeks.

So they advised I use compressed air on the pilot light first.  See if its clogged in anyway.  So shopping expedition for today but I was going out to have lunch with a friend so.  Hey side trip to WalMart.

If that doesn't work, then call them back to schedule.

316: "An increase in gang/cartel violence as they compete for a narrower slice of the smuggling pie?"

When was the last time anyone heard of (without googling it) a shootout over gin distribution?

You are correct that there would be an increase in the intensity of violence. For a while.

The question I have is can the beast be starved? Would a reduction in cashflow lead to a reduction in the number of zetas that the cartel bosses can hire? Would this lead to an overall reduction in violence in the USA?

Of course my preference would be to hand the black bag back over to the CIA and tell them to end this shit. But I'm rather bloodthirsty. Guess it's a good thing I'm not in power.

352 Probably not, the Commission was well insulated against the draw down of prohibition, and while Hoover didn't tackle them, Anslinger did, at least in their offshore operations,

And after last night's shellacking of The World's Greatest Team Ever Invented at the hands of a second-tier Big 12 team, I am hoping for more of the same tonight.
