Happy Friday.

It will not shock anyone to know that in his rush to criticize Justice Scalia for the error (now corrected) in his latest opinion, the New Republic's Brian Beutler made plenty of careless errors of his own.

How is this front page news?

More gossip on David Gregory's 'Meet the Press' troubles.

A Democratic group is suing—successfully—to enforce Citizens United at the state level. It's a good thing, but demonstrates once again Democratic protestations about the case are just noise.

Ya'll have a nice weekend.

1 Good Morning Morons.  Today is Friday, May 02, 2014.  On this day in 1611 the King James Bible was published for the first time in London, England, by printer Robert Barker.   It is still the best selling book of all time.  But you will not see it on a lot of the lists because liberals dominate the industry and they "claim" that many are given away for free so they don't include it.  They neglect to mention that somebody had to buy it to begin with to give it away.

8 We talked a little about the government's abuse of civil forfeiture laws yesterday.  Here is another case of major abuse by the corrupt IRS.  The people in this case eventually got their money back but in an honest world the people who did this abuse would have been personally fined and jailed for felony theft.

12 CNN asks if it was legal to record and release Sterling's rant.  They discuss State law but fail to mention it was also a violation of federal law, namely the electronic communications privacy act (18 U.S. Code § 2511).   There are no provisions under the act for federal punishment, however he can seek damages from his ex-wife.  If he has to fight the NBA in court she will be liable for all the costs, including the cost of the team if he loses it.   I hope she is aware of the shit storm she has made herself liable for. And CNN should do a little research before they publish shit.   And speaking of CNN and other news services who are publishing her crap, perhaps they should talk to their lawyers as well. They are not exempt from this law.

I can't hope to afford the kind of legal assistance required to defend my family in the courts (a fact I think they and the lawyer class in general counts on) if necessary.

So the only alternative seems to be that I must soil myself and start taking law courses. So now I need to find a State college that offers law courses in my area so I can use the Hazelwood act to be able to afford it.

However, their report says he lunged at them.  Eh... sorry, boys.  He did not lunge at you.  His  head bounced off the wall after you punched him.

Which  means the cops are guilty on this one.  I don't always agree  with a lot of people around here who talk about out of control cops, but this one looks  like they're guilty.

79 Some of the Morons have been talking about moving down to the Charleston area.  That area has some of the highest taxes in SC but look at this.

A $200,000 house (about average) will only cost you about $1,000 in property taxes in the city of Charleston, and that includes both city and county taxes.

Good news, every Juan!:

The Republican-controlled Florida Senate voted Thursday in favor of letting students who live in the country illegally qualify for in-state college tuition rates. The bill is expected to pass now and head to the desk of Republican Gov. Rick Scott who has publicly endorsed the legislation for several weeks. "It's an exciting day for every student that dreams of a college education," Scott said shortly after the bill passed. "This is a historic day. Children who grow up in this state now get the same tuition as their peers."

Several times during this year's session the bill appeared in trouble as some Republicans sharply criticized the idea and even said it was "pandering." But it emerged as a top priority for Scott during an election year in which Hispanic voters may play a crucial role.

And the Golden State pinata continues to drop candy for La Raza:

Establishing a system of subsidized health insurance for undocumented immigrants in California won conceptual approval late Wednesday from a state Senate committee.

The measure, Senate Bill 1005, would place the new system under control of Covered California, the state's provider of health insurance under the federal Affordable Care Act, and offer similar benefits.

California's estimated three million undocumented immigrants are now excluded from ACA coverage, which includes billions of dollars in federal subsidies, and covering them, as Sen. Ricardo Lara, D-Bell Gardens, envisions, would require many millions of dollars in underwriting funds, but no precise cost estimate has been made.

Lara believes that his proposed system could enroll about a million immigrants, and told the committee he has a team of academic experts working on the financing issue and hopes to have something in hand before his measure reaches the Senate floor.

"Justice Scalia is not the only one making errors" By Jonathan H. Adler

Brian Beutler, Heal Yourself, you HACK journalist:

"In opinion journalism (as opposed to fact checking) opportunistic inconsistency (as opposed to imperfect diligence) is the mark of a hack. ItÂ’s a big challenge for people who write opinions for a living to keep track of a careerÂ’s worth of their own polemics, but an honest pundit will either account for changing views, or maintain old opinions whether or not they conflict with normative or partisan preferences. That way, even if he forgets his columns from a decade ago, he wonÂ’t be caught in embarrassing contradiction.

"And as long as weÂ’re applying journalistic tests" ...

“I just didnÂ’t write what you said I did.”

I think it is not unreasonable to start with an assumption  the cops acted lawfully, because  they usually do.  You then adjust accordingly, depending on  the circumstance.

I also happen to think it's very very unreasonable to start with a premise that "cops are thugs,"  and then go looking for every sensational news story that shows a possibility of cops acting out of line as  the evidence for  one's  premise.

That sucks.

You want even more outrage?  In Virginia, illegal alien spawn can go to colleges here now at the non-resident rate.  There was a bill this session to give the spawn the in-state rate, which did not pass.

VA Attorney General Mark Herring, who won his seat by like 300 votes, announced that no, actually the spawn can use the in-state rate.

This whole shit business of illegal alien's kids getting in state rates is fucked.  Aside from the principle of it, the reality is that the colleges only have a set number of slots for in state tuition rates.  An illegal alien who breaks all the rules can get his kids into a college and pay the subsidized rate, while an actual citizen's kids, who have grown up in the state and worked hard, get wait listed...because diversity or something.

I would suggest if you go into any given confrontation with cops with that attitude, your  chances of finding yourself on wrong side of the zipper  of a body bag are much greater.

What are you risking by saying "yes sir," and "no sir"  to a police officer's questions, or placing your hands where he/she asks you  to place them, or stopping a vehicle when you are ordered to stop?

If the first words out of your mouth to  being questioned  by a cop are "f'ing pig"  or some variant thereof, you're  probably doing it wrong.

195 And against all that, you have to place the 90 something percent of the time when cops are decent people, acting lawfully, trying to help bring order and safety to a chaotic world. I'll agree to this somewhat. I'm less sure of that 90% number these days, but even the ones who are good guys pretty well have to be dicks these days- and that doesn't help matters. When a cop pulls me over and doesn't smile at me, say "good morning," or anything like that- and every question is asked as though it's a trap ("Do you know why I pulled you over?" what's wrong with, "Sir, were you aware you were speeding?" or just, "Sir, I pulled you over because you were speeding.") it makes it less a person doing a job and more some mindless robot who is enforcing rules with no consideration of circumstance. And I know that characterization is incorrect, but it is, nevertheless, the general perception. And it's mostly required by the rules and regulations they have to follow. So when you add that "distance" to the actively bad cops, and add those to the militarization of the police, it's easy to see how cops are getting a bad reputation.

Oh absolutely, I understand why they are getting a bad reputation.  As you suggest though, it really is a two-way street.

As more and more people who encounter cops are lawless, and as governments create policies where the officers are as a routine  expected to be more aggressive, it's going to get worse and worse for law-abiding citizens.

We're losing something  here.  No question  about it, but  it's a chicken/egg thing, and if the question  is whether cops are more thuggish, or their jobs are more  dangerous because  people they  meet  are increasingly hostile toward them, I'm guessing the  former is more a response to the latter, rather than vice versa.

On that I would heartily agree. That's just common sense. I in no way advocate for being a juvenile dumbass or copping an attitude.

But I no longer view the police as friends or protectors. I now know that they are not there to help me. They are there to generate revenue for the state and enforce its decrees.

I will no longer cooperate with the enforcers. But please note that not cooperating is not the same as resisting. It isn't bad enough yet for resisting.

It is not for us to be insensitive , but let us remember that our life is not a life of feeling. For the life of me, you are correct. Why are people searching for obscure, incredulous, disconnected pieces of writing when the complete body of credible literature and writing is widely know.

Answer. They are trying to falsely back up their preconceived notions.

yep, I know quite a few people who are exempt.  If it's your legal residents on your property-no tax.  They also have a reduced tax rate if you build on vacant land called a homestead.  It takes a couple of years after you build a home but when it kicks in it reduces your tax.  I have a 1400 sf home on 3 acres and only pay around $120 a year.

237 Burt- I don't care why they are thugs, I care that they are thugs.

Just as I am not interested in the trials and tribulations of the mugger who was raised by a single mom in a drug infested neighborhood, I could care less that the cop who caves my head in has a bad chief, and is used to patrolling the worst end of town.

But to your point of origin- I think cops need an outside influence with some authority who can remind them that they are not a gang and all citizens are not "shitbirds" or "scumbags".

238 Posted by: BurtTC at May 02, 2014 08:27 AM (BeSEI) I think the biggest problem is the march to the police-state. We have literal "pre-crimes." Even given that drinking and driving should be a crime (I've expounded on why that shouldn't be before), why should it be a crime to sit in your car after you've had a couple beers? Yet it technically is, if you turn on your car. "Operating a motor vehicle while under the influence" or some-such. As I mentioned before, simply carrying a large amount of cash in your car is seen as evidence of a crime (what crime? Oh, we'll think of one), so they can seize both the car and the money- then have fun trying to get either (let alone both) back. Neither of those are a "response" to a cop's job being "more dangerous." And "I'm just doing my job" *seriously* doesn't cut it as an explanation. So that reduces the public's trust in the police, and "the system" in general.

No joke...there are students with 4.2 GPAs who are getting wait listed at James Madison University. Posted by: @JohnTant at May 02, 2014 08:02 AM (PFy0L) --- Maryland allows in-state tuition rates. As for large amounts of cash?  Who is carrying cash?  How much cash?

308 You'll probably never get me to agree on the matter of vehicles and intoxication. I would probably go so far as to suggest if you stagger out of a bar, swinging your car keys on your finger, or are pointing and clicking your key fob at every vehicle on the lot that looks even remotely like yours, you should be arrested. I'll quote Captain America on this one: "Time was we used to wait until someone had committed a crime before we punished them for it." As for large amounts of cash? Who is carrying cash? How much cash? Anyone, and any amount over a couple thousand dollars. It's assumed, you see, that you're up to no good. And maybe most people carrying that amount of cash aren't, but even in your scenario- no. Simply having the cash- even having the cash and being parked where drug deals often happen- is not evidence of any crime. We jumped the shark the moment we started to believe we should arrest/fine people for behavior which could lead to a crime.

As  you  suggested  however, they are impounding the cash, and making it difficult  for someone  to get it back.  That's not the same as arresting someone for just having large amounts of cash.

I'm sure it gets  abused.  I'm sure there are people who have legitimate reasons for carrying around cash,  who have it confiscated, and then have a difficult time getting it back.

That's injustice.

We have lots of it in this world.  For some reason though, I'm not thinking this is the  worst  of it.

They do. They arrest you, and impound your car and cash. Then, since you weren't committing a crime, they have to let *you* go. But, you see, your car and cash are still "evidence in an ongoing investigation." It can take *years* to get your stuff back. And it could be avoided if the police kept to their actual job- which is not to "prevent" crime. It is to investigate crime and arrest criminals after a crime has taken place.

I don't complain much if I can help it, but, my life, my family, is in many aspects a four-way train wreck. When I read the news, it actually makes me feel better, because it takes my mind off my my own miseries for a few moments, gives a coldly comforting perspective, y'know? Sometimes the solipsism kicks in and I think the world's troubles and mine are hard-wired together, like, if I could just balance and set in order affairs in my own sphere, the nation will follow. I'm trying, really, but I make no progress day-to-day. Sorry. If anyone should happen to have a spare prayer lying around not currently being used, though, please nudge the almighty supreme source and center of all creation, parent of every personality, to spare some strengthening of Family, glorious enhancement of Truth, and healing for the good souls long suffering from unearned mortal ailments. Those categories address my list of troubles, generally speaking. And, yes, I did sneak three prayer requests into one there. Think Heaven will object on technical grounds? Back to reading....

A Manhattan native, Rhodes went on to write the Iraq Study Group Report and help draft policy recommendations for the 9/11 Commission, which Hamilton co-chaired. Obama's Fundamental Transformation continues. Where government policy was once formulated by scholars and historians, now it is written by fiction writers.

You want a police force that serves and protects.

You'll settle for cops that walk around drinking coffee and eating doughnuts.

You'll get the hospital bill for the forcible sodomy after the enforcers steal your stuff.

They will still pull you over when you aren't doing anything wrong, and then go to court with a lie knowing they will be believed over you. So camera up. That's the only way to cover yourself. And when you prove that the cop was lying, the judge won't sanction him for perjury. And the next case he has, he will be back to being hte most credible witness.

368 327 -

Actually, I would much rather  the  cops be preventing crimes, rather than putting tape around the bodies afterwards.

Especially the innocent victims  of  drunk drivers.

There is a theory of law enforcement  that has been shown to be effective at both preventing crime  in the moment, and reducing crime overall.  It's called "hot spot"  policing, and really, lots of agencies don't like it.  It's harder  to do.

It involves this very type of thing, where you know criminal activity is concentrated, you put cops there, have them (within the bounds of the law)  deal with loitering in cars, on street  corners, etc.

It works.  Communities become safer, and believe it or not, studies show when you bust up a hot spot, the activity doesn't just  go elsewhere, it  is actually reduced, to  the point where criminals stop doing criminal behavior!

But yeah, if you are a contractor, or you sell a vehicle for cash (as was suggested upthread), and the cops confiscate your cash as part of their "investigation,"  that's  wrong and unjust.   Again though, not the world's biggest problem, in my opinion.

390 Actually, I would much rather the cops be preventing crimes, rather than putting tape around the bodies afterwards. Then we'll have to agree to disagree. Stipulating that no one likes dead innocents, I'm much more afraid of a police state that can always keep me safe than I am of a drunk driver. And, yes, I know about hot-spot policing. And the key to it is punishing actual crimes. Loitering *is* a crime (in many places). And it's often "broken up" by a simple "move along." It does not involve "stop and frisk" or arresting people for simply being in the area. There's a reason that sting operations have to go right up until the subject has actually attempted to commit a crime. If at any time the subject says, "You know what? No, this is a bad idea" and walks away, the cops can't arrest them. Because "pre-crime" is a horrible infringement on Liberty.

394 So let's posit that the police stealing your money is a less serious problem than them bashing in your front door and shooting you in the face. Okay, I get that. But it all comes from the same place. Lawlessness. They are impervious to the law and to consequences of their actions. Once you give someone blanket immunity, hard to believe, but their behavior does not improve. See Jameis Winston. Or the Obama Administration.

A couple of points on the Cop issue:

-Cops preventing crime...the problem there is that it's just not possible to do in any significant way without being too resource intensive AND trampling on the rights of people.  Cops can't be everywhere, and measures to increase police effectiveness (like cameras and such) lead to a place I'd really rather not go.  OTOH I think more empowerment for law abiding people (relaxation or elimination of concealed carry regulations, for one) goes a lot further in preventing crime as well as preserves people's rights.

-On the cash issue, it doesn't even have to be your money.  I'm the treasurer for a  kid-centered non profit  and we do a lot of stuff in cash.  There are times I'm taking  a few grand in  small bills to the bank.  If the cops stop me and figure that money is evidence of ill-will, well, the money being confiscated impacts more than just me...it will mean a bunch of kids don't get to go to a group baseball game, or a campout, or something similar.

You know who does though? Drug dealers."

You know who needs houses? Drug dealers. And so people's homes are being siezed.

You know who needs hotels? Drug dealers. And so  a hotel was siezed. Because drug dealers used it. It didn't matter that it would be illegal for the owners to refuse service.

You know who needs a car/truck? Drug dealers. So these too are being siezed.

All of this without any wrong doing being proven. And in some cases, the owner isn't even accused of any wrong doing.

But because a criminal has in their possession a fully lawful item or piece of property, by all means. EVERYONE must now be at risk of having their lawful property being stolen.

By the police. Interesting justification you have there.

I guess I was just too young to notice it when the show was on but Chuck Barris looks like he is drugged out of his gourd in that clip.

434 I used to take a couple thousand pounds of scrap to the scrap dealer. It's a cash-only business. You get weighed, you get paid. Walk out with a couple hundred $20.00 bills. Just like a drug dealer. There's a lot of people who need to deal in cash.

Right.

All those wicked  cops, seizing  all those houses  and  hotels  from  innocent citizens, minding their own business.

It's a veritable epidemic, it is!

438 My wife and I started carrying large amount of cash when we first started going to Buenos Aires. We were having extensive dental work done and that's how they do business there. Now, we still take lots of cash because the economy is so screwed up there that U.S. cash trades at double what the official exchange rate is. We are only allowed $10K each but normally take $25K each. I guess we're lucky we haven't been stopped on the way to the airport.

439 From the link "Why Liberals Don't Care About Consequences"

"TodayÂ’s American liberalism, it is often remarked, amounts to a secular religion: it has its own sacred texts and taboos, Crusades and Inquisitions. The political correctness that undergirds it, meanwhile, can be traced back to the past centuryÂ’s liberal Protestantism.

Joseph Bottum ....examines post-Protestant secular religion with empathy, and contends that it gained force and staying power by recasting the old Mainline Protestantism in the form of catechistic worldly categories: anti-racism, anti-gender discrimination, anti-inequality, and so forth.

What sustains the heirs of the now-defunct Protestant consensus, he concludes, is a sense of the sacred, but one that seeks the security of personal salvation through assuming the right stance on social and political issues."

436: "It's a veritable epidemic, it is!"

Of course. It doesn't matter. Until it happens to you.

But until and unless it happens to you, then fuck 'em! Right?

Since when does the number of times an evil happens make any difference in whether or not it is an evil?

But if you were to actually read and look around, you may see that these things are not as rare as you might currently think.

That's just the piety; it requires that the government then becomes God.

450 grammie, atc, any I missed, thank you! Means a lot. __ 20 years and 1 month ago, late at night, we pulled into town ahead of the moving van. Went to our new business location. Place had been abandoned for many months. Before my key hit the lock, local cops pulled up. I introduced myself as the new owner, and praised their alertness, noting it to our trio of youngsters. Good way to start our new life, I thought. Even in Chicago, I had told the kids, turn to a cop if there's trouble. Later, a bully cop was in our place, and slapped cuffs on my 10yo son as a 'joke.' Cop was armed, I was not, and I tried to be all haha polite, but it was the one time I ever wanted to punch a cop. Jerk got in trouble later. Wasn't even a modern steroid thug type cop, just an old-fashioned swaggering bully. But at least it happened when my kids were about the right age to start moderating the idea that Mr Policeman is Your Friend. (Our business for a while served a lot of young folk, and we had a lot of cooperation from very good cops.) That was before Officer "what's that smell?" Green frisked me & searched my car. (Long-winded story linked in nic.) My last significant cop encounter (just a turn signal burned out, no ticket) was with a steroidal, hyper-grim, grilling-me highway patrolman. No problems, really, I marveled about all the cop computer stuff filling the front seat, but his manner made my skin crawl; he was not the Smokey of my youth; different breed, and not better.

451 But if I'm sitting in my car at midnight, with drug deals going on all around me, and they search my car on the suspicion that I'm up to no good, and the cops finds a loaded weapon in my glovebox? Since when is sitting in a car (at any time) reasonable suspicion for any kind of search? Let alone probable cause? Sorry, no. Perhaps I'm sitting in my car at midnight, with drug deals going on all around me, because I'm picking up my [insert ne'er-do-well relative here] who has finally had a "come to Jesus" moment and I'd like to protect myself from the drug dealers. The point is, simply, that the fact other people do things that are wrong should not deprive me of my Liberty. I don't want to live in that world. I want to live in the world where I'm empowered to protect myself and my family, and cops exist to fulfill the the roll they can actually fulfill- investigating crime and capturing criminals-in-fact, not arresting people for being possible-criminals-in-waiting.

Sorry to return to a nearly dead thread  to respond.  But I hear you.  I think it's a good thing  that you want to look at it from a perspective different from mine.  I would hope that helps keep things from  swinging too far in one direction or the other.

There is a reason however, that crime rates are down.  It's not because  everybody loves Obama.  It's because,  at least in part,  of police measures  like the ones I'm talking about.

For every 100  people sitting in their car at midnight, with  a  loaded weapon in  the glovebox, where drugs deals are happening all around them, 99  of those people are there to support the drug  trade in  that neighborhood, on one side of it or the other.

If  I was that one guy, and I had a "valid"  reason for being there, if I was smart I would be aware of the fact  that cops are going to think I'm up to no good, and I would make sure if I encounter one, I conduct  my interaction with said cop  very very carefully.

453 Are we still talking about taxes? $5800 per year for a $260k house on a quarter acre city lot in Corpus Christi. Our assessments show how much goes to the local hospitals to offset the written-off care, no doubt; the junior college on the ghetto side of town, in which my children will never set foot; and CCISD, which my children do not attend. Taking a long hard look at rural southeastern Oklahoma or, even better, rural Tennessee with low property tax rates and no state income tax.
