What Did My Home-Invading Kid Ever Do To Deserve Being Shot While Burglarizing a Home?

I guess "deserving" is the theme of the day.

The two dead teenagers were aged 16 and 14.

As regards "deserving:" I don't know if a 14 year old "deserves" to die for a burglary which doesn't seem to include violence, but the homeowner was well within his rights to shoot the bastards.

I think these two ideas get conflated by people who can't, or won't, keep them separate.

Do I think a 14 year old "deserved" to die so young?

No, but that doesn't mean the homeowner was at fault, either. The 14 year old put himself in an extraordinarily dangerous position, and made life hell for his victims. He also, surely, scared the crap out of his victims.

And the reason that burglary (and especially home invasion) is historically a major crime is because a burglar, if happened upon by a homeowner, is likely to respond with violence, even if he had never planned violence as part of his intended crime.

The homeowner had the right to shoot the burglars. (Actually it seems like it was the homeowner's brother who shot, as she'd invited her brother to stay with her after being burglarized just one week ago.)

It's an outcome that isn't optimal, but the homeowner isn't charged with making sure those burlgarizing her home get precisely what they "deserve." She is permitted to exercise a defense of her person and her home, and she did so. She is not a court of law dealing with questions like "deserving" at the safe remove of reading about a crime on paper.

She is a frightened woman, terrified in her own home by invaders, and her first right (and only true duty) is defense of the self.

She did that.

And speaking of "deserving" -- does she deserve years of prosecutorial abuse for merely defending herself and her home?

7 The way I have always looked at it they may as well have shot themselves when they decided to do a home invasion burglary.   Yes they did get what they deserved.  And the age for these types of hoods is immaterial.  They probably already had a rap sheet longer than my johnson.



Them only thing I would draw the line at is shooting them multiple times after they were already incapacitated on the floor.

Not particularly, some punishment, maybe some community service, perhaps some time in Juvie is what he deserved. Was being shot a possible (probable even) outcome? Yes. First and LAST time I ever took something that wasn't mine. No record, but scared the beJebus outta me. How a 14 year old gets to burglary not once, but twice, without something stopping him, is a mystery to me and clearly reflects the lack of limitations that might have kept him alive. I do not feel the slightest bit of sympathy, but I do feel for the poor shooter who has to live with this for the rest of his life. He did the right thing, but that is still a lot to carry.

Conservatives in general, I think, like the idea of customs, social norms, and self-restraint because it reinforces positive behavior and minimizes behavior that is risky or that can lead to confusion. This means that the state has to spend less time and energy intruding into every aspect of people's lives in order to determine the truth of an event and carry out justice.

278 This story is what bothered me about the trial in MN recently, where a homeowner shot a teenage boy and girl who broke into his home. The guy hid in the basement and shot them both when they came down the steps. Stupidly on his part, he recorded audio of the whole thing, shot the girl twice because the first shot didn't killer her, then got scared and didn't call the police for 24 hours. Things didn't go well for the homeowner. Granted, his actions were a bit over the line, but to me, if you don't break in, you don't get shot. End of story. Prosecuting people for shooting someone who breaks into their home sets a shitty precedent. Invariably, it becomes a case about "Did they deserve it" and delving into information and what-if scenarios for months that there was no time for during a break in. Threaten me or what is mine, you will get shot. If I pull a trigger, I am not looking to scare you, teach you a lesson, or injure you. If you are going to prosecute me for defending myself or my property, then let's stop with the charade and just hang up "come take what you want" signs on everybody's stuff. Might as well, since if they don't outright steal it, they're voting for people to do it for them.

351 I'm far from saintly, but I like to think that if one of my close relatives turned up dead burglarizing some old lady's house for the second time, I would have sense enough to ask some important questions before too many hours passed: 1. Is any of the stuff he stole the first time still in the house? 2. If not, can we get it back from whatever friend he gave it to, or the pawnshop he sold it to? 3. If either of those is a 'yes', what would be the best way to go about getting the stuff back to its rightful owner, with apologies? Interesting that such questions don't seem to even occur to friends and families of today's thugs. Explains a lot about how they turned out that way, doesn't it?

Philip K. Dick wrote a short story in the '70s on this idea.  Apparently parents somehow had gained the "right" to "abort" their children all the way up until the child's 6th birthday.  Kids who made it past that mark would lord it over the 5-year-olds: "My folks wanted to keep me!"

This shooting was just the logical extension of that idea up to age 16, I guess.
