4 Good Morning Morons.  Today is Thursday, April 17, 2014.  On this day in 1905 the Supreme Court decided Lochner vs New York and struck down a law that NY had passed limiting the number of hours a baker could work.  This precedent was held up until 1937 after FDR packed the court it was reversed and brought in a number of new federal laws that allowed the government to regulate everything.

10 Is your electric meter spying on you?  The new "smart" meters track usage just like the old meters did.  The only real difference is they send that value to trucks driving by so the meter reader doesn't have to get out of the truck and read the meter, thus holding down labor costs. People are worried about nothing.

Morning ‘rons and ‘ronettes.  It seems to be Louis B. Mayer week here, so IÂ’ve got another story.  IÂ’ve told it before, but itÂ’s a good one that always bears repeating:

 

Between marriages, Mayer dallied with a minor MGM contract player named Ginny Simms.  At the time, he was also investing in racehorses and learning to ride, himself.

 

One of the new MGM players was Frank Sinatra, whom an impressed Mayer had purchased from RKO in 1944.  Although Frankie caused a number of headaches for his directors (namely, showing up late and his insistence on only one take per scene, so as to stay “fresh”), he was liked on the lot and respected for his work ethic.  But Sinatra also had a loose tongue, and itÂ’s that which got him in trouble.

 

It was April of 1950.  In the studio commissary at lunch, hearing that Mayer was injured during a riding accident, Sinatra joked, "Nah, he fell off Ginny Simms.".  Instantly, the table went silent.  Sinatra had made the ultimate faux pas, but he didnÂ’t realize it. 

 

Naturally, the remark made its way back to Mayer, who summoned an unknowing Sinatra to his office.  Putting his arm around Frank, Mayer began as he usually did with his male stars, “Frank, I never had a son.  YouÂ’re like a son to me.”  He continued on and on in this vein, praising SinatraÂ’s work and saying how proud he was of him, how much he was like a member of his own family.

 

“Holy shit,” Frank remembered thinking, “HeÂ’s leaving.  HeÂ’s going to give me the studio!”

 

But then Mayer eyed him carefully.  “But I hear bad things about you, Frank.”

 

“What things, Mr. Mayer?”

 

“That you tell stories.  Awful stories.  About me and Ginny Simms.  You donÂ’t do that, now, do you Frank?”

 

Sinatra felt like heÂ’d been poleaxed.  He couldnÂ’t deny the joke – obviously, Mayer knew – but how could he admit it?  Finally, he muttered something about, yes, it was a bad joke,  he was sorry and he didnÂ’t really mean it. . .and he was shown out of MayerÂ’s office. 

 

On April 27, 1950, he was fired.

The Huy Fong Foods Sriracha factory, makers of the popular hot sauce with the rooster on the label, may be ready for a big move.

Amid its current legal woes with the city of Irwindale, which voted last week to declare the factory a public nuisance, Huy Fong Foods owner David Tran says he's considering moving the business to another city.  Tran has expressed a desire to stay put, but took people from 10 states and numerous cities in California on a tour of his factory Wednesday to discuss relocating.

The city of Irwindale has given itself the power to enter the factory, find a solution and serve Huy Fong Foods the bill if it does not grant the company 90 days to fix the odor during its next meeting.

Earlier this year, Texas State Rep. Jason Villalba sent Tran a letter, asking him to consider moving to Texas.  "The great state of Texas would welcome you and your employees with open arms if you would consider moving... Texas could provide you with exactly what you need to continue to grow, build and maximize the opportunities of Huy Fong Foods."

Rep. Mario Diaz-Balart (R-Fla.) warned Wednesday that President Obama would use executive action on immigration if Congress does not come up with a proposal by the August recess.

Diaz-Balart, a leading Republican advocate for immigration reform, said the window would close on negotiations for a comprehensive deal if that happened.

“I’m convinced that if we don’t get it done by the August break, the president, who is feeling a lot of pressure from having not done anything on immigration reform, will feel that he has to act through executive action,” he told The Washington Post.

58 MPPPP, I'm going to neck pain doctor. I'm chronic pain patient & neck has been worse & makes my shoulder hurt. For almost two months. I should have made appointment when it started acting up. He'll probably give me two series of two injections. They don't hurt when he does them but are very painful for days afterwards, I have roses coming today & more next week. It's not exactly planting weather. I haven't finished pruning & am not sure how many died over the winter. Thanks for asking.

You're right, the stuff we know about rapists and sex offenders is bad enough, including the fact  that sentences for violent rapists are  all too often, way too lenient. 

The problem is, nobody really knows the  scope of the problem, and  there isn't any real way to predict who will  re-offend with anything close to certainty. 

Which is why it is such a "civil rights"  hot potato.  You can't keep them all locked up forever, so where  is our "acceptable" level of risk?

I had a thought this am that is relevant to this line of argument -- the accepted as valid but mostly hidden concept of jury nullification.  A jury can ignore the law if they feel that justice would be best obtained by doing so. Judges hate to have this mentioned to any jury.
 
This situation is sort of a pre-jury stage of the same concept.

The problem is that the definition of what makes a "sex crime" has become so broad as to lose a lot of it's meaning.  For instance, you can be charged with a "sex crime" if you are seen outside somewhere taking a leak where someone else could see you.  Or some guy in, say, his 20s gets caught boinking a 16 year old girl.  Wham, he's a "sex offender" for life, never mind that there was nothing forcible about what took place, or that the girl knew more about matters sexual than the guy did.  I'm not saying that jumping underage girls is proper, but in their untrammeled haste to find child molesters, rapists and the like, a bit of, shall we say, perspective has been lost.

That recidivism rate Vic cites is so low because so many people have been convicted of a "sex crime" that, in reality, was not something that fit in the same category of child molestation or forcible rape.  And you can ask any cop; child molesters and rapists have a close to 100% recidivism rate; a nontrivial difference.

We're pretty confident we catch most things - we review his homework every night and look through his reading assignments to see what the material is saying.  It's pretty easy because the texts are all online these days so we just log into his account and look through his assigned reading.  The curriculum isn't too concerning to me, but the side units like health aren't quite as transparent.

My initial goal of talking to my children about what they learned in school every day was to ensure that they were, in fact, learning. That I have to monitor this process for things they need to unlearn pisses me off to no end.

I've taken to the philosophy that my kids' teachers aren't there to "teach."  That's my job as the principal tutor for my kids.  The teachers are there to give out tests.  My goal is that each one of my kids knows what the teacher is going to "teach" before they walk into their classrooms. 

 

Most times it works out OK, but then when the schools start in on the stupid shit I get blindsided.

I think the difference is that I can opt into having a smart phone.  Can't opt out of a smart meter.

 

Not that I think they are big deals, but I also think customer preference should be playing a larger role than it does in the issue.  I can't think of a reason a public utility shouldn't let a member of the public decide if they want one or not.  Maybe through an incentive program...if the labor costs are lower for a smart meter, give that customer a discount for having one. 

 

Of course they won't...if anything they'll charge MORE to someone who wants a standard meter.

Again, I don't have a problem with smart meters, not really.  Of all the things I worry about, smart meters come in around page 194 of my list.

Inre data security, I'm assuming that since private utilities are usually regulated monopolies, government can get that data when they want anyway...especially when the utility needs government approval for a rate increase. 

 

That said, yeah, I'm not one to raise a stink about them but if they are being pushed to save the power company money, then the customer should see some of that benefit.  Usually they don't.

There are even advantages to people coming 'round, like they sniff the meter for leaks every time. But on the whole, remote reading makes sense. One big problem with any electronic gimcrackery is that a fail electronically can be more trouble to fix or work around than a mechanical failure. Think car windows under water. A broken mechanical meter, you may only lose count of zots used. A broken electronic meter may cut you off. All In the design. But it won't be optimal. MAINLY As long as 'meter' means 'monitor' rather than 'regulate,' no problem, really. When the smarter thermostats and meters of tomorrow are under Greenazi Central Control, that's a different story.

255 All I know is the people of this country have allowed our betters to rack up a 17.5 trillion dollar debt, a debt that cannot possibly be paid off. They have allowed a system to be created that has an unfunded liability debt of anywhere from 127-167 trillion dollars. They have allowed a system of immigration that will change the makeup and identity of their own country. An on the ball fully engaged citizenry does not allow that to happen.

256 Mindful webworker, in regard to your question, As long as 'meter' means 'monitor' rather than 'regulate,' no problem, I live in CA and they send you this detailed usage report telling you how you compare to your neighbors and then give you many different ways you can save the world if you do this or that.  My dad lived in GA and before his death I was there and the conversation came around to the fact that the energy company had the ability to shut down sections of town's air conditioners during peek hours, thus saving the world.  That right there is control.
