Political Hardship Exemption: Obama Administration "Quietly" Suspends Individual Mandate,
— Ace

They've expanded/extended the so-called "hardship exemption" by executive fiat again.

The hardship exemption now includes not only poverty or extreme personal distress, but "feeling inclined to vote for Republicans this year."

Obviously it's completely political.

[L]ast week the Administration quietly excused millions of people from the requirement to purchase health insurance or else pay a tax penalty.

This latest political reconstruction has received zero media notice....

That seven-page technical bulletin includes a paragraph and footnote that casually mention that a rule in a separate December 2013 bulletin would be extended for two more years, until 2016. Lo and behold, it turns out this second rule, which was supposed to last for only a year, allows Americans whose coverage was cancelled to opt out of the mandate altogether.

In 2013, HHS decided that ObamaCare's wave of policy terminations qualified as a "hardship" that entitled people to a special type of coverage designed for people under age 30 or a mandate exemption. HHS originally defined and reserved hardship exemptions for the truly down and out such as battered women, the evicted and bankrupts.


But amid the post-rollout political backlash, last week the agency created a new category: Now all you need to do is fill out a form attesting that your plan was cancelled and that you "believe that the plan options available in the [ObamaCare] Marketplace in your area are more expensive than your cancelled health insurance policy" or "you consider other available policies unaffordable."

The new "interpretation" of the hardship exemption requires only that someone state his belief that there are better plans out there, which of course there are. Therefore anyone can legally ignore the mandate, just by certifying this belief.

Obamacare will be on the ballot in November, as it was on the ballot yesterday in Florida 13. Jim Geraghty sees no point to the Democrats' spin that David Jolly "underperformed" in a Republican-leaning district (which nevertheless voted for Obama).

David Wasserman, House editor of the nonpartisan Cook Political Report, declared, “If Dems couldn’t win an Obama CD with a solid candidate against a flawed R, expect a rough November… Bottom line: #FL13 result suggests House GOP still on track for gains this November, perhaps in 5-15 seat range.”

We know the real fight in November is in the Senate races, and you know whatÂ’s less Democrat-friendly territory than this R+1 swing district? The states of West Virginia (R+13), North Carolina (R+3), Louisiana (R+12), South Dakota (R+10), Alaska (R+12). Arkansas (R+14) and Montana (R+7). Those are all currently Democrat-held seats. And there are seven of them.

If last nightÂ’s result means that a halfway decent Republican candidate can win on Republican-leaning territory by hammering away at ObamacareÂ… then the odds of the GOP winning the Senate look very, very good. That means that the competitive Senate races in places like Colorado, Iowa, Michigan, and VirginiaÂ… thatÂ’s all gravy. Bonus seats. A cushion for the tougher set of seats up for reelection in 2016.

Almost hard to believe, isnÂ’t it? Amazing what happens when Democrats get to enact the laws they want.

Lots of states are passing "flexibility" rules which let you take your hours overage as "comp time" which is like Vacation, but usually expires after some time. And places can force you to take the comp time over the time and a half as well (because you're still be compensated for the work.) That and this will likely cause more scaleback to 32 hours a week as a buffer (if someone is no longer salary why not treat them like hourly.)

As crappily horrific as an Obama admin is, I do wonder if it isn't a strange blessing in disguise. He would have run eventually, probably in 2016, and would have had eight years more of political experience and building connections and learning how to actually play the game properly. Hillary would have done everything he has done, but more competently and shrewdly. Now, should she win, she will be in 100% Obama damage control all the time, cleaning up his mess.

Of course, the blessing in disguise hinges on the GOP gaining a 2014 senate majority and turning the Obama implosion to their advantage and winning over disillusioned Obama voters and independents. That might be a hill too far for this sorry bunch.

And I say that as someone who did what amounted to phone tech support and was considered "salaried." And remember- the other option is always contract work, which employers will soon begin pursuing. Why pay someone salary + benefits + (now) overtime (oh- and employer portion of taxes, and so forth), when you can, instead, hire a bunch of I9 employees, pay them slightly more than their pre-tax salary would have been (but way less than your costs would have been), and get the same thing. Oh, and when *they* work 50 hours, you only have to pay for fifty hours, not 55. Which of these situations is worse for your theoretical $11.25/hr employee?

The House will vote again this week on legislation to delay the mandate. The bill is also tied to legislation that would prevent a reduction in payments to doctors under Medicare.

You can't force an employer to pay more than market wage.  They will find a different option, economics forces them too.  Sometimes that option include closing a business, sometimes it means cutting staff, benefits, perks, etc.  The money does not come from the govt, it comes from customers and they have to compete.  It is why illegals get work for less, not because they are jobs Americans won't do.  Govt interference has priced legal work out of the market.

As professionals, they have the discretion to manage their time as they see fit.  If they take 40 hours or 50 hours to do the same task, it doesn't matter to the employer, as long as it is done by the due date.

Mandatory overtime means that all of those salaried workers using "overtime" hours to accomplish the same tasks as much more efficient workers are going to be absolutely fucked.  Because they will not be allowed to stay later.  They will not be allowed to pace themselves.  Their internet use will be monitored.  Efficiency will be enforced.

In short, they will no longer be treated as professionals.

I quit an hourly with Amazon, contract to hire.  The manager told me to be there when his FTEs were.  They were there 60 hours / week.  So I said, fine, I could use the overtime.  He says no, no overtime, you will report 40 hours.  I said shove it up your hole.

I've held a number of jobs in the course of my life. I've never minded the dirty jobs or the jobs requiring heavy physical labor or the low-paying drudgework jobs. I come from working class people. My mother brought me up to respect honest work and honest workers and all that. A day's work for a day's pay? No problem.

 

That said, the very worst jobs are those where the company fucks you over on pay or comes at you in small, petty, nitpicky ways, or treats you like a serf, or yells at you, all with the attitude, 'If you don't like it, go somewhere else.' In short, those employers who treat people badly as a company policy. Treating people badly never made sense to me and doesn't intuitively seem like good business practice but so many businesses practice it that screwing people over in tiny but very legal ways must somehow eke out greater profits somewhere.

 

To the point: you write, 'go elsewhere'. Okay, fine, but what if there's nowhere else to go? The manufacturing sector of my home town was hurt badly by the recession and never really fully recovered. Factory jobs are still scarce and when locals in manufacturing find one, they hold onto it for dear life. Does that mean then that employers can screw over their workers with a clear conscience, and that if their workers don't like it, they can leave it? That's your take?

 

I think the Republican Party should transition to a more populist approach and appeal to those working people who have been shut out by the Democrats. It should also distance itself from groups like the US Chamber of Commerce and shed its image as the party of business once and for all.  As long as Republicans are identified with bosses and all-around assholery in the workplace, we're going to have a problem.

Jen ... at one point I ran Electrical Maintenance for a Mfg. They did EXACTLY that. Salaried the techs, cut their 40 hour check 10%, laid off 1/3, put the on five twelves. Since they were now salaried, no OT for the extra 20.

But see, that's the thing.  That is NOT what the judge asks the jury in a civil trial.  In a civil trial the judge asks the jury to determine whether the preponderance of the evidence (a significantly more lenient standard than the "beyond a reasonable doubt" standard required for most criminal cases) would lead the jurors to find the defendant LIABLE to the plaintiff for damages.  The words "guilty" and "not guilty" are never once mentioned in a civil jury instructions, nor should they be.

To non-attorneys this may just sound like semantic caviling (which is why the Brannon fraud verdict is so toxic anyway), but it's emphatically not.  It's a hugely important distinction.  Liability =/= guilt, no matter how much they may appear to be analogous concepts.

Overtime was theoretically possible but rarely rarely authorized - they only authorized it if you had to come in at midnight for implementation. Guess what - you still had the hard deadlines. You still ended up working 80 hours a week. You couldn't charge overtime for that coz it just proved you were an under-achieving coder. Except that you had to punch a timecard and got yelled at if you were 5 min late in the morning or coming back in from lunch. Overtime for salaried work ain't the promised land.

It's actually worse than that.  They screened 200 on the phone before they called me to interview in person.  The reject pile is at least ten to one before they even call you.  IOW about 2,000 applicants for that position.

You want to know the real reason why the copy repairman was designated as salary?

I'll give you a choice.

a) He's fucking slow.  He takes twice as long to do the same amount of work, and the employer was sick of paying the guy extra time and a half to do the same amount as others who get it done in 40.

b) The government mandated time and a half for extra hours instead of straight time.

c) abuse of overtime rules by lazy fucks looking to bump their pension payouts (see every public sector union ever)

d) inability to pay by the job instead of by the hour.

e) The employer is an asshole.


Your argument maintains that e) is the only possible answer.  I submit to you that if you want to fix the problem, you have more to worry about than just the employer.  Employers do a lot of reacting to asshole employees who have been taught, and taught well, to exploit everything they can.

They usually have some of the worst employees, the worst customer service, and they don't stay in business long term. How is gov. coming in and saying that a bad employer simply needs to pay his employees more make up for a crappy work environment? If your employers is that inconsiderate of the work environment, then they will simply find a way around the rule, which will screw you over even more. Let the market dictate what you get paid and the conditions you work in (other than safety). If the economy were such and the government less intrusive, more businesses would be vying for more business and employees, a win for all. Google is an example....they bus their employees from their homes in SF, something that costs extra to the company. Why do they do that? Because they are looking for really good employees. They've determined that this is a perk that the type of employee they are looking for values. They could simply give them a parking stipend, etc. but this obviously is what their employees want. Same with the salaried positions. Many people want a salary position because the nature of the work and their own personal situation makes a salary position more favorable. Now we have the gov. coming in and ELIMINATING that choice from businesses and employees...because..fairness.

You do realize that, on the civil side, literally 1% or 2% of these cases actually go to trial, right??!!  THAT'S ON THE HIGH SIDE.

 

A trial is a very scary thing.  Totally unpredictable.  And it took them TWO DAYS to come back with a verdict.

 

Did Brannon stand on principle and fight this?  Absolutely.  Was it the smart thing to do given his interest in running for Senate?  Absolutely not.  It was very risky to do this. 

 

I like a fighter and would be excited to vote for him.  It takes balls of steel to go to trial as a defendant, especially considering what he had to lose not just $$ wise.  But if I was running his campaign I would have told him to settle this, or at least continue the case as long as possible!!  lol

496 I can't imagine where all this talk of "screwing the workers" comes from. As someone who has run manufacturing plants, there is no logical reason to do it. Hourly pay in U.S. plants is not that big a factor in the overall scheme of things. In operations like we had, CNC turning, milling, broaching, centerless grinding, gear cutting, etc. labor costs were in the 16% to 18% range. Even if you successfully screwed employees, you could only reduce that by a few percent - far less than what would be worth it after you count in replacement costs of employees. Our factories ran with 50 hours minimum per week (10 hours mandatory overtime) with everyone encouraged to work at least 5 hours more on top of that. In this type of manufacturing, once the machines are up to temperature and running smooth, you want to keep them going for the highest throughput. Employers know that they make money when everything runs well and people are happy. There is no incentive to fuck people over.

My maternal great-grandfather started working in the coal mines when he was 12 because kids could wiggle through smaller spaces in the mines than full-grown men. At 18, he struck out on his own and went to Indiana and found a factory job where he wouldn't, you know, fucking die. As an aside, Duke Energy denied that black lung disease was an occupational hazard in coal mining until forced to acknowledge the connection in the 70's. Was it a bad thing for federal and state governments to implement child labor and work safety laws and regulations? 

 

The GOP has an opportunity here. It can step up and claim as its own those we used to call Reagan Democrats, working people who love our country and don't identify with the rent-seeking goals of the coalitions of the Democratic Party. That opportunity is lost if the Ayn Rand acolytes and  laissez-faire crowd have their way. If it helps, the US Chamber of Commerce--particularly on immigration--has proven itself not to be a friend of conservatism. They just love the thought of all that sweet, cheap labor that millions of suddenly legalized illegal immigrants would represent, and are currently the same big money donors bankrolling those we call the GOP Establishment, the same ones who think Jeb Bush, that squishy loser, is the man of the hour, largely because of Jeb Bush's pro-amnesty stance on immigration reform.

All done initially with good intentions. I don't see where the majority of readers here are advocating that safety laws, child labor laws, etc. be removed. Most early government laws and safety standards were common sense laws that were a benefit to both employee and employer. What has happenend now is that common sense is no longer the driving force in instituting laws. It is political pandering. It is the creation of the Dept. of Labor, something not in the constitution , and it's growth, bloat, and political bureacracy that posters are against. The country is rapidly coalescing into two classes: those who work and receive little benefit from government entitlement programs and those who don't work and who receive enormous benefits from government entitlement programs. Industry wide standards signed onto between individual companies? Who would make up those standards? This is why unions used to fight for their work rules to become the standard prior to there being any kind of legal standard. OSHA was developed out of a need for a third party mediator. Problem is , like with any political body, it becomes, political. As with gov. itself, the problem is how to control it, not that it needs to be totally eliminated.

Mitt Romney was easy to portray as a corporate fat cat aristocrat complaining about the dirty, nasty peons taking money more properly spent on a fourth parking garage in his palatial mansion. Romney's 47% comment was a noose around his particularly well-heeled neck, which was unfair in the first place since--if memory serves--he was referring to that segment of the voter demographic who couldn't be transformed into GOP voters in 2012, and wasn't making any kind of denigrating remark about poor people at all.

 

Besides, that 'fat cat' accusation couldn't be made against a candidate from a more modest background, which encompasses just about any possible GOP candidate except Jon Huntsman, whose family is as well-to-do as Romney's.

543 Here s an ugly little fact: it may be pushed out but the damage is done. We are a small company that had the most generous health care plan possible. Employees paid zip for everything. We maxed them out. Paid boatloads into HSA s and stuff like that. In December for renewal we found our " equivalent " was a bronze plan. WTF? Well it is all about the deductable. It got kicked to the moon. Even after we maxed out our contributions there will still be a gap . That is the quiet killer. If an employee of our plan gets sick, he ll be ok. If he gets really sick he is out thousands. That is how this shitshow will play out for those in bad shape. It is done. But some broad at Georgetown Law gets her birth control pills paid for so i guess it s a wash.
