— Ace They've expanded/extended the so-called "hardship exemption" by executive fiat again.
The hardship exemption now includes not only poverty or extreme personal distress, but "feeling inclined to vote for Republicans this year."
Obviously it's completely political.
[L]ast week the Administration quietly excused millions of people from the requirement to purchase health insurance or else pay a tax penalty.This latest political reconstruction has received zero media notice....
That seven-page technical bulletin includes a paragraph and footnote that casually mention that a rule in a separate December 2013 bulletin would be extended for two more years, until 2016. Lo and behold, it turns out this second rule, which was supposed to last for only a year, allows Americans whose coverage was cancelled to opt out of the mandate altogether.
In 2013, HHS decided that ObamaCare's wave of policy terminations qualified as a "hardship" that entitled people to a special type of coverage designed for people under age 30 or a mandate exemption. HHS originally defined and reserved hardship exemptions for the truly down and out such as battered women, the evicted and bankrupts.
But amid the post-rollout political backlash, last week the agency created a new category: Now all you need to do is fill out a form attesting that your plan was cancelled and that you "believe that the plan options available in the [ObamaCare] Marketplace in your area are more expensive than your cancelled health insurance policy" or "you consider other available policies unaffordable."
The new "interpretation" of the hardship exemption requires only that someone state his belief that there are better plans out there, which of course there are. Therefore anyone can legally ignore the mandate, just by certifying this belief.
Obamacare will be on the ballot in November, as it was on the ballot yesterday in Florida 13. Jim Geraghty sees no point to the Democrats' spin that David Jolly "underperformed" in a Republican-leaning district (which nevertheless voted for Obama).
David Wasserman, House editor of the nonpartisan Cook Political Report, declared, “If Dems couldn’t win an Obama CD with a solid candidate against a flawed R, expect a rough November… Bottom line: #FL13 result suggests House GOP still on track for gains this November, perhaps in 5-15 seat range.”We know the real fight in November is in the Senate races, and you know what’s less Democrat-friendly territory than this R+1 swing district? The states of West Virginia (R+13), North Carolina (R+3), Louisiana (R+12), South Dakota (R+10), Alaska (R+12). Arkansas (R+14) and Montana (R+7). Those are all currently Democrat-held seats. And there are seven of them.
If last nightÂ’s result means that a halfway decent Republican candidate can win on Republican-leaning territory by hammering away at ObamacareÂ… then the odds of the GOP winning the Senate look very, very good. That means that the competitive Senate races in places like Colorado, Iowa, Michigan, and VirginiaÂ… thatÂ’s all gravy. Bonus seats. A cushion for the tougher set of seats up for reelection in 2016.
Almost hard to believe, isnÂ’t it? Amazing what happens when Democrats get to enact the laws they want.

Yes Obamacare was supposed to destroy the insurance industry and private healthcare. We all know that.
But this is such an epic clusterfuck. The very name of the law, and thus the name of our SCOAMF, has become a laughingstock. And real people everywhere are getting screwed.
Are they really this lazy? This incompetent? This utterly stupid?? Perhaps our only saving grace is what a disaster the dems are. Surely the GOP can't figure shit out. If we do not take the Senate over in 2014, it will literally be the worst failure in politics in my lifetime.

and re 67: I believe that only applies to people who work for the government...
and now that I think of it, I beleive it is possible for a person to work overtime one week and get time off the next week, but they must be part of the same pay period and if you do 4 hours overtime in week one you must get 6 hours paid time off in the next week.

The first plan was to destroy the insurance companies so they could enact single payer (many of them have admitted that single payer is the goal). But grabbing another huge chunk of gubmint spending, fuck the deficit, has a lot of appeal too. And singe payer is a dead dead dead political option right now.
No matter that it hastens the end of the dollar and the economy. That's like a fourth or fifth level worry, if it is a worry at all for the Dems.

As crappily horrific as an Obama admin is, I do wonder if it isn't a strange blessing in disguise. He would have run eventually, probably in 2016, and would have had eight years more of political experience and building connections and learning how to actually play the game properly. Hillary would have done everything he has done, but more competently and shrewdly. Now, should she win, she will be in 100% Obama damage control all the time, cleaning up his mess.
Of course, the blessing in disguise hinges on the GOP gaining a 2014 senate majority and turning the Obama implosion to their advantage and winning over disillusioned Obama voters and independents. That might be a hill too far for this sorry bunch.

And also to require the attractive ones to go to trade shows and high-profile meetings. All legal, all uncompensated.

You know I agree with you on Tillis v. Brannon. But you'd be on stronger ground around here if you would stop using the term "guilty" w/r/t to Brannon's civil fraud verdict. Now I know, and you know, that such distinctions (liability in a civil trial vs. guilt in a criminal trial, and the respective jury burdens of each) are going to be meaningless if Brannon becomes the GOP candidate and has to defend against attacks from Hagan, the MSM, and outside groups...but around here at least it's a good idea to be more careful with your word choice, because otherwise people will suspect you of arguing in bad faith.

You can't force an employer to pay more than market wage. They will find a different option, economics forces them too. Sometimes that option include closing a business, sometimes it means cutting staff, benefits, perks, etc. The money does not come from the govt, it comes from customers and they have to compete. It is why illegals get work for less, not because they are jobs Americans won't do. Govt interference has priced legal work out of the market.

As professionals, they have the discretion to manage their time as they see fit. If they take 40 hours or 50 hours to do the same task, it doesn't matter to the employer, as long as it is done by the due date.
Mandatory overtime means that all of those salaried workers using "overtime" hours to accomplish the same tasks as much more efficient workers are going to be absolutely fucked. Because they will not be allowed to stay later. They will not be allowed to pace themselves. Their internet use will be monitored. Efficiency will be enforced.
In short, they will no longer be treated as professionals.

I've held a number of jobs in the course of my life. I've never minded the dirty jobs or the jobs requiring heavy physical labor or the low-paying drudgework jobs. I come from working class people. My mother brought me up to respect honest work and honest workers and all that. A day's work for a day's pay? No problem.
That said, the very worst jobs are those where the company fucks you over on pay or comes at you in small, petty, nitpicky ways, or treats you like a serf, or yells at you, all with the attitude, 'If you don't like it, go somewhere else.' In short, those employers who treat people badly as a company policy. Treating people badly never made sense to me and doesn't intuitively seem like good business practice but so many businesses practice it that screwing people over in tiny but very legal ways must somehow eke out greater profits somewhere.
To the point: you write, 'go elsewhere'. Okay, fine, but what if there's nowhere else to go? The manufacturing sector of my home town was hurt badly by the recession and never really fully recovered. Factory jobs are still scarce and when locals in manufacturing find one, they hold onto it for dear life. Does that mean then that employers can screw over their workers with a clear conscience, and that if their workers don't like it, they can leave it? That's your take?
I think the Republican Party should transition to a more populist approach and appeal to those working people who have been shut out by the Democrats. It should also distance itself from groups like the US Chamber of Commerce and shed its image as the party of business once and for all. As long as Republicans are identified with bosses and all-around assholery in the workplace, we're going to have a problem.

But see, that's the thing. That is NOT what the judge asks the jury in a civil trial. In a civil trial the judge asks the jury to determine whether the preponderance of the evidence (a significantly more lenient standard than the "beyond a reasonable doubt" standard required for most criminal cases) would lead the jurors to find the defendant LIABLE to the plaintiff for damages. The words "guilty" and "not guilty" are never once mentioned in a civil jury instructions, nor should they be.
To non-attorneys this may just sound like semantic caviling (which is why the Brannon fraud verdict is so toxic anyway), but it's emphatically not. It's a hugely important distinction. Liability =/= guilt, no matter how much they may appear to be analogous concepts.

I personally feel for the people who live in towns where the jobs dry up. One mill towns, or one smelter towns or whatever. At the same time, I lived in the third world as a military brat. When a location became unlivable because of flooding or whatever, do you know what the people did? They strapped their belongings to their back and marched out of there. Exploitation occurs where market forces aren't allowed to give the employees other options. And that happens when government fucks things up.
You want to fix the problem? Get rid of idiot Democrats. Don't pander by claiming that this bullshit overtime thing does anything to fix a problem. As with anything government, it does nothing for it.
It just makes conditions even worse for salaried people and hourly people alike.
And if we had an opposition party with an ounce of brainpower, they could make that case.

Basically, it's now a massive expansion of Medicaid with some elders and "children" getting basic insurance for nearly nothing.
All the funding mechanism have been eliminated. The entire program is now funded by middle class people who have had to switch to the exchanges b/c of cancellations. In a year or two, the citizens of each state and the middle class people who pay most of the federal taxes will be charged with paying for all the coming insurance bailouts as well.

Scrogg, do you know why it changed? Government interference. They decided that certain employee classes were entitled to 40 hours pay even if they didn't work 40. That is salaried non-exempt.

It's actually worse than that. They screened 200 on the phone before they called me to interview in person. The reject pile is at least ten to one before they even call you. IOW about 2,000 applicants for that position.

I'll give you a choice.
a) He's fucking slow. He takes twice as long to do the same amount of work, and the employer was sick of paying the guy extra time and a half to do the same amount as others who get it done in 40.
b) The government mandated time and a half for extra hours instead of straight time.
c) abuse of overtime rules by lazy fucks looking to bump their pension payouts (see every public sector union ever)
d) inability to pay by the job instead of by the hour.
e) The employer is an asshole.
Your argument maintains that e) is the only possible answer. I submit to you that if you want to fix the problem, you have more to worry about than just the employer. Employers do a lot of reacting to asshole employees who have been taught, and taught well, to exploit everything they can.

You do realize that, on the civil side, literally 1% or 2% of these cases actually go to trial, right??!! THAT'S ON THE HIGH SIDE.
A trial is a very scary thing. Totally unpredictable. And it took them TWO DAYS to come back with a verdict.
Did Brannon stand on principle and fight this? Absolutely. Was it the smart thing to do given his interest in running for Senate? Absolutely not. It was very risky to do this.
I like a fighter and would be excited to vote for him. It takes balls of steel to go to trial as a defendant, especially considering what he had to lose not just $$ wise. But if I was running his campaign I would have told him to settle this, or at least continue the case as long as possible!! lol

You've never heard of highways being closed due to severe weather? It's done because it is a lot easier to keep people off of some roads than have to go in and rescue them later.

Instead of arguing in favor of an Obama policy that doesn't work, maybe you should be concerned about government interference that helps create the conditions where workers can be exploited.
The solution is educating the non-skilled labor to stop voting for Democrat policies that eventually screw them over, not to go along with every populist idea out of Barky's mouth.

Look at how many here are four-square in favor of salaried classifications for pretty much every job under the sun.
Alot of the Trades Guys talk politics with me. About 1/3 of them are Closet Republicans. Bet they have no fucking clue just how good being Salaried would be for them.
After today, I gotta' admit, I see no reason for them to ever think of leaving their union.

My maternal great-grandfather started working in the coal mines when he was 12 because kids could wiggle through smaller spaces in the mines than full-grown men. At 18, he struck out on his own and went to Indiana and found a factory job where he wouldn't, you know, fucking die. As an aside, Duke Energy denied that black lung disease was an occupational hazard in coal mining until forced to acknowledge the connection in the 70's. Was it a bad thing for federal and state governments to implement child labor and work safety laws and regulations?
The GOP has an opportunity here. It can step up and claim as its own those we used to call Reagan Democrats, working people who love our country and don't identify with the rent-seeking goals of the coalitions of the Democratic Party. That opportunity is lost if the Ayn Rand acolytes and laissez-faire crowd have their way. If it helps, the US Chamber of Commerce--particularly on immigration--has proven itself not to be a friend of conservatism. They just love the thought of all that sweet, cheap labor that millions of suddenly legalized illegal immigrants would represent, and are currently the same big money donors bankrolling those we call the GOP Establishment, the same ones who think Jeb Bush, that squishy loser, is the man of the hour, largely because of Jeb Bush's pro-amnesty stance on immigration reform.

You can not have it both ways. GOP supporters can't repeatedly support the elimination of overtime pay ... then expect the losers of that pay to feel anything but screwed.

My argument is that the GOP should take a more populist approach and at least make the attempt to shed its friend of big business image--which isn't really so much true anymore anyway, given the rampant corporatism of the current Administration.
The country is rapidly coalescing into two classes: those who work and receive little benefit from government entitlement programs and those who don't work and who receive enormous benefits from government entitlement programs. In short, makers and takers. Presented this way, the GOP can portray itself as the party of makers and beat the Democrats on their own class-war turf.

Mitt Romney was easy to portray as a corporate fat cat aristocrat complaining about the dirty, nasty peons taking money more properly spent on a fourth parking garage in his palatial mansion. Romney's 47% comment was a noose around his particularly well-heeled neck, which was unfair in the first place since--if memory serves--he was referring to that segment of the voter demographic who couldn't be transformed into GOP voters in 2012, and wasn't making any kind of denigrating remark about poor people at all.
Besides, that 'fat cat' accusation couldn't be made against a candidate from a more modest background, which encompasses just about any possible GOP candidate except Jon Huntsman, whose family is as well-to-do as Romney's.
