— Gabriel Malor The Obama administration has one again unilaterally and unlawfully extended the delay in enforcement of the Obamacare employer mandate.
The government will now exempt companies employing between 50 and 100 full-time workers from complying with the mandate to offer employees affordable health insurance by another year, until 2016.
It will be such sweet turnabout to use the Obama Precedent against Democratic programs in 2017. The Obamacare employer mandate is actually a tax enforcement statute. Having established that Presidents can simply decide not to enforce taxes they do not like, I can't wait for President Perry to start nixing taxes by executive fiat. Also, that pesky EPA that holds down economic growth? Sayonara sucker!
[Update 5:45pm] CAC has informed me that I misspelled "President Walker" in this post. I regret the confusion, but I was referring to the 46th President, Rick Perry, not the 45th President, Scott Walker, whom I'm sure you all fondly anticipate uses the Obama Precedent not to enforce the federal income tax. Again, I regret the confusion.

You have your opinion and we have ours. Many other constitutional scholars believe Obama has exceeded his executive powers and have laid out the case quite convincingly. The Court has also found that the mandate penalty is a tax. Does that make any opinion contrary to that silly?

OK, then, turn it around: Any person who refuses to abide by the ACA individual mandate to buy insurance and is fined by the government should sue, on the grounds of selective enforcement. At least one court has already cited the selective enforcement as a reason for throwing out the contraception mandate for conscientious objectors.
A law that is only selectively enforced should not be honored or obeyed by anyone, for it is illegitimate. At some point you exempt so many people and businesses that anyone who actually complies is simply a chump.
This is how Obamacare gets killed. When people simply start laughing at the government and refuse to comply with any of it.

If we're going to get back to Constitutional law, then we need to start getting back to Constitutional law. Executive fiat is the same for repubs as it is for dems. Let's reform this clusterfuck that we have now the right way.
It really hurts to say this because I want to run roughshod over the dems too. But we must return to the Constitutional law of the land no matter how slow it will seem to take.

I caught a piece about a decade ago about a surgeon who had spent his early career in uniform before leaving to work at a civilian hospital. He received a recruitment letter from the five-sided puzzle palace on the Potomac, inviting him to go back on active service as a military doc in the sandbox. Very favorable bonuses were offered.
He responded saying that he was always willing to answer his country's call in a moment of peril, but perhaps they should know first off that he was ninety years old and had not been in clinical practice for nearly two decades.

On the one hand, I have come to absolutely loathe John McCain.
On the other hand, I recall vividly back in 2008, when they considered McCain a proximate threat rather than a regular ally, how the institutional left ginned up one of the ugliest anonymous smear campaigns I have ever witnessed in my entire life, in which they accused McCain of personally starting the terrible fire on _Forrestal_ by pulling a reckless flight deck stunt.
Let's remind ourselves that this is not a trivial allegation about a minor incident. There was huge loss of life among the ship's complement. Basically they felt it was perfectly okay, on the basis of no evidence at all, to accuse McCain of mass homicide of his fellow servicemen.

As for Hyde, I recall a cynical parody of "Dr. Jekyll and Congressman Hyde", in which Hyde was instead actually the mild-mannered of the two.
The only really fighting leader the GOP House contingent has had in living memory was Gingrich, and he had shitty judgement about which fights to pick.
(Hint: don't impeach a President over an adulterous affair while your own caucus is full of flagrant adulterers, including your own self. Lousy optics there.)

Left-wingers in the Congress who disagreed, and who actually had the intestinal fortitude to use the power of the purse against an incumbent President, then inserted appropriations language which specifically forbade any federal funding for the contras -- the Boland amendments.
And then they dared Reagan to veto those budgets containing those prohibitions.
Reagan folded. (And then tried the ridiculous gambit of extralegal funding which eventually exploded as the Iran-Contra Affair.)

A ton of Obamacare implementation and funding goes through HHS. The House could slash HHS funding to the bone. Or explicitly defund the entire department, transferring its critical responsibilities (i.e., non-Obamacare responsibilities) elsewhere. Throw Sibelius out in the street.
The House could also insert legislation explicitly ruling out the use of any federal funding to rescue insurance companies that are in over their heads with Obamacare. (This would result in the immediate exit of Aetna, who are already publicly very nervous about the lossmaking potential for themselves, and likely of others.)
Obamacare promises the states federal reimbursement for the Medicaid signups that have come via the Obamacare exchanges. The House could take a meat ax to those reimbursements, and leave the states which have heavy Medicaid burdens to pick up the extra costs ahead of schedule, which would be a lovely thing to watch those predominantly Obama-fellating blue states endure.
(I live in Commiefornia. That would be an iceberg below the waterline for this state's finances. A disaster for we Commiefornians. But so much fun.)

Per your link, one big one is an HHS slush fund. But if HHS gets a fat cut to its budget of the sort previously suggested, say thirty percent off the top, there ain't gonna be much slush left in that fund.

That is a scary thought. I didn't bring it up in the Sunday Book Thread because I was only about 20% into it but the book I'm forcing myself to read right now is called 'Dancing In The Glory of Monsters.' It deals with the situation in the Congo, Rwanda, etc., in recent decades. Trying to make sense of it is horribly depressing. The prospect of heading down that path here is pure horror.

You're eliding a step here, which is the House meekly rolling over and voting for continuing resolutions, which are the way that the money gets doled out in the absence of proper budget agreements.
Which is something they do not necessarily have to do.

Not so far, about halfway through. But if his activities are mainly in and around Kenya, that is very far away from the region this book covers. It's a big continent. The continental US would fit three time into Africa.

JackStraw, I am aware of no measure by which the "shutdown" was a win or loss for anyone. Maybe I missed something. I do know that the exits in VA did not show it hurting Cuccinelli, which is about the best real-world proxy I can think of (timing, extent of welfare, er, government employment in VA).
Regardless, the GOP lacks "leverage" in actually insisting on lawful governance, with respect for example to budgets, because it simply lacks the will. Or, alternatively, we have a situation where there really is no rule of law whatsoever, and the GOP lacks leverage because there exists no mechanism in the system to require compliance with the constitution and law in governing the country. No other possibility, logically speaking.
The primary control mechanism that actually is in the constitution, and which has in practice been the major "lever" for limiting lawlessness, is in fact the House's power of the purse. It has even sufficed for forcing national security disasters on the country, and that area is constitutionally dominated by the executive (abandonment of South Vietnam prior to the Northern offensive in 1975). The House simply refuses to use that power. CRs serve to gut the House's normal budget clout - heck that was true back when they usually were for 1 month or so. Now that they have essentially replaced the appropriations process, the House has in effect ceded its key power.

I loved Monticello when we went there on a family vacation when I was 15 or so, the magnificent library/study especially. In most homes the kitchen is the heart of the house. Jefferson's study was the heart of his home, I think. At least, that's where I thought his presence was most strongly felt.
