Chauvin Judge: Sure, Maxine Waters' Threat of Neverending Riots May Cause This Case to be Reversed on Appeal, But I Won't Grant a Mistrial

Unbelievable. You'd almost think that various elements of the Thug State are coordinating to make sure Chauvin goes to jail, even if completely innocent.


Remember, this judge previously refused 1, moving the trial to somewhere where the jurors would not be as emotional -- and as intimidated -- as they are, and 2, sequestering the jury so that they could not follow the news and would be somewhat insulated from public opinion -- and public threats.

He refused both of those.

Now, those decisions come back to invalidate the entire trial, because Maxine Waters has made extremely serious threats against both the city and, implicitly, the jurors themselves if they don't return a verdict that Burn Loot Murder can support.

The judge overseeing former Minneapolis police officer Derek Chauvin’s trial hinted at a possible appeal after hearing the defense team’s argument that Democrat Rep. Maxine Waters’ recent call to violence if the trial does not result in a guilty conviction could influence the jury’s verdict.

"My phone gives me alerts on things that just happened. I mean, you can’t avoid it,” Chauvin’s attorney Eric Nelson argued. "And it is so pervasive that I just don’t know how this jury, it can really be said to be that they are free from the taint of this. And now that we have US representatives threatening acts of violence in relation to the specific case is mind-boggling.”

 

"I’ll give you that Congresswoman Waters may have given you something on appeal that may result in his whole trial being overturned,” Judge Peter Cahill conceded before hearing the state’s position.

The jury, Cahill believes, will not be swayed by Waters’ rhetoric.

"They have been told not to watch the news,” he explained. "I trust that you’re following those instructions and that there is not in any way, a prejudice to defend beyond the articles that we’re talking specifically about the facts of this case. A congresswoman’s opinion really doesn’t matter a whole lot.”


And the judge still says: I'm not declaring a mistrial. I'm going to trust that the jurors followed my instructions to not follow the news.


Sure. Sure none of them follow the news of the Daily Riots and Arsons.


Sure, none of them considered what Burn Loot Murder has in store for them.


The formerCaliforniahome of a defense witness in theDerek Chauvinmurder trial was vandalized with a pig's head and blood smears most likely tied to his testimony from the trial, police said.

Last week, Barry Brodd, the retired police officer, said he believed the former Minneapolis officer was justified in his use of force during the George Floyd arrest.


The Santa Rosa Police Department issued a statement on Saturday that said it seemed that the "suspects in this vandalism were targeting" Brodd for his testimony. The statement said the vandals seemed to have targetedthe wrong home because Brodd has not lived there for years.

 
I'm sure none of the jurors suspect that their names will be revealed to the world within hours if they fail to deliver a Burn Loot Murder-approved verdict.

Let's see if basic judicial process might apply here.  Even if convicted, will Chauvin be allowed to remain "free", on bail, while his appeals are heard?

Or, are they so eager to railroad him into prison asap, so that he can be duly murdered there, as is the way of their people?

17 The judge this entire time is hoping that the jury votes to convict, but the justice can be handled on appeal so he can get out from under this case himself. He knows his name is already targeted by mobs and he's doing his best to get this case done and over with so he can go sequester himself away from the mobs. 38 I'm guessing the mistrial motion was strategic and Nelson wanted it to be denied.  Nelson wants a result here; throwing away an entire trial's worth of effort and expense is something no trial lawyer wants unless the trial has gone really really badly.  From what I've read, it hasn't gone badly at all.
If Chauvin walks, Nelson's job is done and the denial of the motion is moot.  On the other hand, if Chauvin is convicted then Nelson has one more arrow in his quiver in the court of appeal on which to seek a retrial 
This is just an additional bit of insurance against a bad result.

43 As I said in the previous thread, this judge wants this trial out of his courtroom as quickly as possible. He's been threatened, DA and Defense have been threatened, as have witnesses and jurors.
I'd hazard a guess the trial wasn't moved, because, you guessed it, more threats.

The  judge wants a verdict, then, he'll wash his hands of the case and see it sent off for appeal.

When some of those jurors get physically attacked, and tried to defend themselves with a legal weapon, you can bet your bottom dollar they will immediately be arrested, hounded by authorities, and charged with murder.

I recall years ago, when the Zimmerman attempted lynching, er, "trial"*, was with the jury, the guy who sharpened skates across the street from the rink was saying he planned to close immediately whenever the verdict was released.  I questioned him on this.  He's in a sportier area, or closer to one, than I usually am, but still.

67 Also generic appellate stuff:  if you do not move for directed verdict or for a mistrial, you end up waiving that on appeal because the appellate court will say if it is so bad we have to overturn it, you should have brought it up then.  That's why you see so many what appear to be idiotic motions, it's paper trailing for appeal.

I think the severity of the National Guard presence in the last week sends a very different signal than last year. It's pretty clear that they aren't fucking around this time. However, push hasn't come to shove yet, and there's no way of knowing what the state's response will be if rioters begin targeting wealthy residential neighborhoods, white outer suburbs, etc., or if they become truly violent against law enforcement; overwhelming mobs forcing retreat, targeted gun violence, etc.

I just saw a post of these "masks" for kids that for all the world look like colorful Gimp masks. They're full head cover, with a built in visor and a zipper for the mouth. One photo showed a kid eating his Fruit Loops with the zipper open. Sadly, the children after a year aren't going to remember what it was ever like to not be wearing masks. 


There needs to be an entirely new circle of hell for these people.

Good grief, I really wish Jake Tapper wasn't dumb enough to tweet that out, and get retweeted tens of thousands of times, thus freaking out half the country.

The court kept a text transcript, but, like nearly every major trial in America, they aren't giving the jury a complete transcript to read at their leisure. The point is that the jury was supposed to keep individual notes about the most important stuff. That's what they are supposed to reply upon when making decision. However, the jury can ask the judge to instruct the court reporter to read back specific parts of the transcript, if necessary. Happens all the time. They bring the attorneys, jury, media, etc., all back into the court room, and read the transcript aloud for everyone to hear.

No worries. Sorry if I sounded rude. Just pisses me off that Jake Tapper didn't know better. In some cases, judges can refuse to read back part of the transcript, if he thinks they're focusing on stuff forbidden by the jury instructions, or getting lost in petty details late in deliberations, possible hung jury situation. If you give a jury a complete transcript, then there's no way of knowing what they're doing. Court room read back is a safety net.

So it's cheaper to buy. Kind of like 9 mm. Or .308. Or, previously, .45 ACP or .38 special. 
It comes down to availability and cost. If the military standardized on something else, that would likely be the most available and cheapest round, and you'd likely see people migrate to that new platform.

How? This is the inevitable result of every civilization ever. We got there a bit faster than some, but much slower than others, but I don't know of any civilization in human history that got to this point in the corruption / decline and came back. At least not in similar form.
Look at most countries in the world today -- utterly corrupt from the local traffic cops up to the head of the government. How does one go about fixing something like that? If everyone in power is in on it, and it's part of the institutional culture, there's really not a whole lot people can do.

He was probably right to not declare a mistrial, it's on the record, and available for appeal, as the judge noted. Which is pretty big, judges don't usually say "yeah, you'll probably be able to appeal my decision on this one" even if everyone in the room knows it to be true. He's basically screaming to the lawyer "get the paperwork ready, here's me saying in the fucking on record transcript that this decision can / should be appealed."
But I think from the judges perspective it's that even if he declared a mistrial, and they started all over again, this shit isn't going to stop. It's not like everyone will calm down between now and whenever the next trial starts, and it's not fair to the state or to the Defense to make everyone go through the time and expense of doing the whole trial over again. 
Better to get a verdict, then have an appeal, where an appellate court will get to decide if there is a new trial or not, and hopefully by then things will calm down. Yeah, it sucks that Chauvin could be sitting in jail during that time, but again -- this is just going to keep happening until a verdict is reached.

without pics the snap cap either failed (why I buy metallic ones), or there was something screwy with the seal at the headspace depending on weapon model-it's a snap cap ideally remove the bolt and the weapon is safe as houses to transport.....

use the best tool available for the job, procure one, or take it to a gunsmith the advice on using wood has to do with not ruining your barrel.

Depending on how sturdy it is you could use your cleaning rod.

Oh and if you use something to hit the stick with, use a rubber mallet.
And a block to prevent the rod from splitting.
